Filing 2 i130's for 1 person

Hi everyone, 

 

Is it possible to have 2 130 applications going at one time?  I am in the process of petitioning my parents to join us in the US this year.  I have a sibling whom I'd also like to get the process going for.  My brother is in his mid 20's, unmarried and is pursuing a medical career in Canada (this will likely change over the course of 15 years... well the married part, I believe).  He does not want to leave Canada within the next handful of years but is hopeful in wanting to join us wherever we end up... which works for us because if I sponsor him, it'll be at least 15 years before he gets the chance of choice.  

 

We thought that since it takes so long that I would apply for him now and if in 15 years and the time comes and he decides to move, he can.  Or if he chooses not to at that time, he can forfeit his application.  But at least, we are able to start the process now versus decide in a few years and have to start then.  But then it got me thinking... my parents would be eligible for citizenship within 5 years, if they decide to go for it.  They would then be able to sponsor my brother as well (likely shorter than the 15 years, if he's unmarried still at that time).  We would then have to file a separate i130, this time as my parents being the petitioner.  Is that even allowed?

2015

April 09 - Interview - Delayed due to sealed package from civil surgeon not at local office

May 07 - GC in production

May 18 - GC in hand!!!

2017

Feb 9 - ROC 

Feb 14 - Check Cashed

Feb 16 - NOA 1

Feb 25 - Received Biometrics Appointment

2018

April 10 - N400 Application

April 29 - Biometrics

January 29 - Combo Interview / Recommendation for Approval 

February 20 - Oath Ceremony - NATURALIZED

You can have multiple petitions going.

 

After all one may die whatever in the process so good insurance.

A beneficiary can have multiple I-130s from different petitioners.

 

What country was your brother born in?

 

An LPR parent can file for an unmarried son over 21.  No need to wait for your parents to get US citizenship.

Thank you and you are absolutely right.  We discussed that and folks think we're odd to discuss things like that but these things have to be said.

Not many natural-born Canadian families tend to move to the US, probably not much on vj. 

 

Can have multiple petitions going.
