Hi there, 

 

I was hoping for some advice my son who will be immigrating with me as an America father who isnt listed on the birth certificate but i have the relevant court paperwork and DNA tests granting me full custody with him surrendering all rights and wavering all parental visitations etc... he's never seen his son or paid any financial contributions towards him even thou hes been ordered to by the courts but thats a separate issue.

 

I know i will have to list him on my sons DS-160 form...

 

I also know he has 3 children that are half brothers and sisters to my child... 1 i know the full details of the other 2 i dont have details like birth dates etc... but these aren't required

 

My question is do i have to declare the step siblings even if my child has never had any contact with their father or the step siblings. 

 

Will I need to take the court documents with me... and will i need a letter from his father saying he can immigrate even if hes not listed and has never met his son

He has no say in if your son can move. Take the court record in case they want proof.

Can you copy/paste the exact wording of the question on the DS-160?

Do you have any immediate relatives, not including parents, in the united states?

 

(means fiancee, spouse, child or siblings) 

 

and thank you for your help I know i will have to declare his father in the first part its the second part that is troubling me

So these 3 kids live in the US? Is it a yes/no or asks Info about them. You could answer "unknown". You wouldn't necessarily keep up with the details of an estranged ex.

Yes they do... its a yes / no then with further information like there name / relationship to you
