Traveling on I-751 with waiver

Hello everyone!

I traveled 2 times after receiving my 2 years card.

First time when I got to ORD POE they sent me to secondary and I waited there for 50 minutes. At the end they just handed me my passport and GC and I was free to go.

The second time, I got to the CBP officer and he started asking me all this questions (felt like it was another interview): if I'm still married? where my wife works? what she does for living? when is her birthday? when we got married?, etc.

After I answered all his questions, he stamped my passport and I was free to go.

The question is (just assuming, since I couldn't find the answer here):

If I'm divorced and I have my form I-751 filed with a waiver, but my GC is still valid, will that be an issue to enter, since they ask all this questions about my marriage?

there is a lot of reasons, why they pull you to secondary. Wont start a list of possible reasons; it's ok to travel with a valid GC, even if you are divorced.

 

From my experience: You can travel using GE (global entry) and by a miracle....all your problem with a CBP officer/immigration officer could disappear. I have not been sent to secondary ever since I got GE

I don't think there's anyway to travel with GE and the extension letter.  I'd love to be corrected though.

if you have an extension letter, meaning your GC is expired, you won't qualify for GE. I assume you are already doing ROC right?

Yeah, my husband already has Nexus (which includes GE), but now that his green card is expired and we have the extension letter, I don't think the global entry machines will work for him anymore.

yeah, it wouldn't work because a human has to physically see the extension letter. What you can try to do is use the "mobile passport app" to accelerate your entry at POE. Those lines where last time I entered ATL way faster than regular immigration lines

The first time the CBP officer said that they need more time to process me, so they send me to the room.

Maybe because that was my first time entering with new GC and it was my first travel in many years.

And how did you get approved for GE?

you have to apply and disclose any misdemeanors or felonies you have ever had. it is entirely up to them, to issue or revoke you for GE. It cost $100 non-refundable. Some credit card offer to pay for this if they you ever apply for it with their credit card, so free of charge.  It takes about 1 month to respond with the GE card in the mailbox and you go for an interview and fingerprints at a major local airport that has GE or assigned agency. They have them in major metro areas mostly. I just read yesterday that the service is not working, because of the government shutdown.

I had a DUI back in 2012. It was stricken off my record, but I think they still can deny based on that.

not all misdemeanors or felonies are gone completely as you think. I disclosed my misdemeanor and the records where destroyed in a fire, but the digital records of how the case turned out, where available. This is the US government, and not a US State that will be accessing your records. They have like USCIS access to way many more databases than you think. Not all felonies and/or misdemeanors are just a fact for denial. They make that determination and you will not know, if you never apply. IMO it was not the $100 that made me discouraged and look I do still have GE. It simplifies the entry at any POE in the USA. Hope this helps to make a better informed decision.

Timeline

What they look for in an applicant is the level of threat in the security for the most part. Someone with DUI or fraud are categorized in different ways. With fraud....the potential of them carrying something illegal into the country is much more likely, than someone with a drunk driving record that may have had a beer to much.  Of course this is a matter of point of view, but as long as it is disclosed.... I also have a TWIC card which has way more security requirements than GE and backgrounds are also done for that.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

I applied yesterday and will see how it goes
