Obtaining SSN for minor kids

Timeline

Hi VJ friends. I just wanted to know if my kids ages 11, 9 and 8 could apply for their social security number even with an expired I-94. We don't apply for the AOS yet since we are still in the process of saving for the AOS fees. Since it will be a hefty amount for the 4 of us. My question is, will it be possible to apply for their social security even with an expired I-94 on their passport? I really appreciate your answer guys. Thank you in advance.

Nope. You need at least 14 days of valid status remaining for K-1. And K-2 holders don't qualify for an SSN right away.

You will need to apply for AOS + AP + EAD. With the EAD or green card you can get an SSN.

For tax purposes, if you don't have an SSN for them by then, you can try to obtain an ITIN, or you can file without claiming the children as dependents then amend later once they do have SSNs.

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

8/15/2017: POE
