Hi, I am an US Citizen living in Venezuela,  I decide to move to the US on January 2019, I am in the US right now for 10 days, I wonder if I can send the Visa K1 petition to the USCIS, and return to Venezuela. I brought everything I need letters and forms with my fiance signature. The oonly thing is that I am not permanent living in the USA yet.

You can file the I-129F from inside or outside the US. It goes to the same place either way.

While not needed with the I-129F, keep in mind the I-134 financial requirements for when you get to the interview stage (in ~8-12 months).

My sister who live in the US will be my fiance"s sponsor, do I need a sponsor too?

You're a USC so you don't need to be sponsored for anything.

Generally the petitioner must also be a sponsor for the beneficiary, although not all embassies/consulates do this.

 

When you get to the AOS stage (after entry on the K-1 and marrying), you must be a sponsor even if you have a joint sponsor.

You should provide 1 letter of intent to marry from the petitioner, and another one from the beneficiary. Only sending one letter with just one party can result in an RFE.

No such letter is required.

You can answer the question on the I-129F where it is asked, use the last page of the I-129F to provide additional details, or add an attachment. If using an attachment, no signature is required, but generally the petitioner signs it as the I-129F is the responsibility of the petitioner.

 

I would just add that there is no need to go into too much detail...just answer the question being asked. People have received RFEs for providing unnecessary details that raised questions. Nine times out of 10, the space on the I-129F is sufficient for this.

If you are living together in the beneficiary’s home country you might want to seriously consider marriage now and filing a CR-1 spousal visa. This is almost always the best option if you are already living in the same country. The K-1 is great for couples who have no other option to get married (they live in separate countries and the beneficiary cannot get a B-2 to marry the USC in the USA as a visitor and the USC cannot travel to the beneficiary’s country to marry due to costs, paperwork requirements, visas, etc).

 

The spousal visa will mean the beneficiary can work immediately, has a GC immediately and can become a USC faster (if that is the aim).

Hello, everyone have told me that if we got marry first and ask for de spouse visa, is going to take longer, I meant that the procedure take more time to be approve,  it is that true?
