Okay I am trying to help out a friend. This is OMG their 2nd petition the first was denied by USCIS because the lawyer didn't respond to the 2nd RFE in time. Now here we are 3 years later 2nd petition filed earlier this year and miraculously approved within 90 days. June 18th. But guess what no trace of it. USCIS doesn't have it NVC doesn't have it.

Now the lawyer messed up this to and the NOA2 letter has the,

"The above petition has been approved. The petition indicates that the beneficiary is in the United States and wishes to adjust status to that of a lawful permanent resident. The evidence indicates that he or she may not be eligible to file an adjustment of status application.

Because the benficiary does not appear eligible to adjust status in the United States we have sent the approved petition to NVC".

Any suggests wheer to go to find this missing petition.

Seems the lawyer messed up the whole thing again by filing the i130 and i485. Your friend should ask for the forms filed and verify from uscis by calling.

When was the case approved? From my findings it takes (2-8 weeks) for an approved petition to get from uscis to nvc .. I guess its in transit . it has left USCIS but hasn't gotten to nvc .. I guess you have to wait or keep calling nvc ..

Case was approved June 18th, 2018. So 4 months no record of it at USCIS. NVC no record of it. And weird thing the lawyer refuses to give over the I-485 receipt# imagine a lawyer doing that. Oh and since all mail from USCIS goes to Lawyer they never seen the NOA1 letter either

My spidey senses say that my friend is being scammed. Not even the approval letter looks right. And they were approved in 2 months time after a denial of not returning evidence on time. 2 months approved seems so suspect to me.

I mean can't they call USCIS and petitioner give his name and SS# and they look up that way to verify what petitions he has in system?
