How would this affect our application.

Hello all. I’m not sure if I’m posting my question in the right place, but I’m in the process of adjustment of status. My husband is petitioning me. But as of Thursday he was laid off from his job. We’re really stressing out about money and also wondering how this would affect our petition  i485. He’s looking for another job, to where there’s not much gap and to where we won’t need a sponsor since honestly we don’t have anybody we could ask. My question is if he was to receive unemployment benefits and try to work doing other jobs would his unemployment money be considered income? We’re  still waiting for our interview and I’m sure it won’t be until sometime next year I think.

Yes, unemployment income does qualify as income for sponsorship. Usually it is not sufficient to meet the I-864 requirements in itself, and other income earned is usually negated by the decrease in unemployment compensation as a result of the income.

There is no requirement to submit a new I-864, but at the same time the IO can request a new one (especially if they learn of the unemployment in the interview), so having  anew I-864 ready just in case is wise. A joint sponsor can also be added at the interview.

Hopefully he finds a new job soon.
