Reaffirmed after interview put on AP again 2018

I have a question on a reaffirmed case. I file I130 for my husband 2014, He had his interview on June 2015 and given 221g. They kept us on AP for a year and return to USCIS.On July 2016 we received NOIR and denied again Sept 2016. The lawyer I had before he didn’t do a good job of putting our case together, for that reason we were denied. I hired a different lawyer she files the I290B Motion to Reopen. She did a great job on our case we were reaffirmed last year January 2017 we were so happy about our reaffirmed. The case was sent back to the consulate in Sri Lanka for a second Interview. The embassy received our reaffirmed case February 2017 we were back on AP whole year no movement at all until this year the CEAC says “expiring soon” The lawyer email the consulate let them know what's going on, consulate email the lawyer have my husband pick up the package and schedule him for second interview March of this year. Before the interview, he had to do another medical exam and police clearance and after the interview, we were back on AP again and kept his passport. I'm so confused we were on AP for a year and after the second interview AP again NO VISA😞 this is so depressing and heart-aching.

Why was your case returned the first time?  

 

How did the second interview go?

 

AP is so broad that no on can really give an answer.   While it was in AP for a year before the second interview did you contact the senator?  Have you contacted the embassy recently to check the status?  If not I would do so.  You want to make sure they are not waiting on anything.   If the only answer you get is its in AP I would get in contact with your senator and see if they can help you get more details.

I was denied for not bonafide marriage.

The second interview went well. Consular asked a lot of questions, then she asks for documents and phone bills, but she didn't ask for any Skype calls so my husband didn't provide to her. I don't know if that's going to be an issue.

After the second interview, my lawyer kept sending emails to the embassy they don't responses to her emails, I don't know why but they did before the interview.

I did contact the senator office they did send an email to the Embassey on Jully the response was "our case still on administrative processing. We understand that patience is required, but we continue to work on this case. He will be notified for any additional requirements or progress."

 

I haven't contacted the embassy since July, I was told to contact them every two months, I'm going to start contacting them every month..I'm gone have my lawyer send an email to consular on Monday. 

 

1. Can they deny our case without given 221g?

2. They took his passport is that good or bad?

I received this email from consular:

Our office is waiting for certain clearances to further process your case. We understand your difficulty because of the delay in the processing. The timing for these clearances are generally based on the history of the case. Our office will contact you as soon as your case gets the clearance.

 

Is this mean we still on AP?

Yes, but it tells you more than that.  AP is a catch-all term for anything between interview and visa issue or denial.

So it means they’re waiting for an answer from Washington to get the AP to be clear?

I don't think the "where" is relevant, but if it makes you more comfortable to think that's the where, so be it.  It says what it says.  It says more than just AP.
