Hi, 

My mother is an American citizen since birth. I got my IR2 green card before my 18th birthday in 2014 and entered USA as a LPR only 20 days before I turned 18. In the U.S. Embassy in my hometown they told me that I am protected under Child Citizenship act but I guess they don't know the details for IR2 visa etc. However, as I already got admitted to an university in my hometown I need to return to Turkey. Now I am done with school and I want to live in USA with my mother. My mother was usually with me in Turkey for the past 4 years but she visited to USA occasionally. So, when I go back to USA am I still eligible for a US passport etc. ? As there were 20 days until my birthday, my mom and I were not able to reside together in USA before my 18th birthday for a long time anyways. I saw some threads which some people

also entered USA just before their 18th bday and got their passport in 2-3 months even though they turned 18. There is also another problem. I was not able to visit USA since 2015 as I was going to college and doing mandatory summer internships. Do I have to get a returning resident visa and if I have to what are odds that they will give me one? The embassy officers told me that my green card was special and I can continue my education in Turkey, I don't have to go back every year back in 2014. I tried to consult the embassy again but they only accept me if I complete  DS-117 form. I am very confused. My brother also got a green card and he is still under 18 can he get his passport when he returns to USA this year with my mother? We both cannot drop our schools immediately . Thank you in advance.

I think the only chance you and your brother have getting back into the US is by applying for a US passport. From outside the US. I don't know the details of this but you should look into it.

 Your mother is a USC and you both entered before turning 18. Get the passport application started and hope you have all the paper work to prove to them you met the requirements.

Based on what you described you became a U.S. citizen the moment you entered the U.S. with your IR2 immigrant visa under the age of 18 under the physical custody of your U.S. citizen mother. Apply for a passport directly through the U.S. embassy and gather all your paperwork.

Adjustment of Status From F-1 Visa.

8/14/2014: Mailed AOS package: I-130, I-485, I-765.

8/18/2014: Accepted in Chicago. Transferred to Nebraska Service Center.

8/21/2014: Received NOA 1. I-130, I-485, I-765 in mail.

8/25/2014: Received biometrics in mail. Scheduled for 9/8/2014

9/24/2014: EAD approved. 36 Days!

10/01/2014: EAD mailed.

10/03/2014: Received EAD card.

10/14/2014: I-485 moved to testing and interview.

1/28/2015: Interview scheduled for 3/4/2015.

1/31/2015: Received interview notice.

3/4/2015: Interview completed and APPROVED!

3/5/2015: Welcome notice mailed and I-130 Approved.

3/10/2015: Welcome notice and I-130 approval notice received.

3/12/2015: Green card mailed.

12/07/2017: Notice of action issued. (IOE)

12/26/2017: Biometrics.

01/23/2019: Interview Scheduled for 2/27/2019.

02/27/2019: Joint I-751/N-400 interview. N-400 recommended for approval.

05/16/2019: N-400 APPROVED! Placed in line for oath ceremony.

05/17/2019: Oath ceremony notice mailed.

06/12/2019: Swearing in Ceremony! Finally a U.S. citizen!
