Does the US fiance has to have a job during the K1 visa process?

Hi friends,

 

My US citizen fiance has just returned back to US and established his residency. He has enough savings and a house of his own but currently is unemployed.

 

I wanna know if his unemployment will be an issue with the I-134 form that is asked during the interview and the approval of our K-1 fiancé visa?

Depends on if he has enough assets to cover the required amount for the I-134. If he doesn't, then yes being unemployed is a problem and he would need a co-sponsor.

02/03/2017 - Married

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I’m employed and probably earn 4 X times the min requirement, but I’m also going get an appraisal on my home so I can include the equity of my property as assets. I don’t plan on leaving nothing to chance. I would research how much reserves (assets) are required if unemployed and possibly seek a co-sponsor who is willing to be financially responsible for you during the next 10 years.

Yes! He has good savings and has his own house. As he has recently returned back to the US for good, he doesn't have a job yet. He wants to take a break for sometime but I am wondering if the NOA2 comes early when he is still unemployed then how will it effect.

 

Also, for the interview at the US embassy, do I need to submit the original I-134 form (Affidavit of Support) with his wet ink signature or is it acceptable if he scans the form and I take a printout and submit that COPY of the duly completed original form?

Short term employment is almost like being unemployed, it is recommended to get a co-sponsor.

 

Savings wise he would need to show a lot of banking records to show the money has been there for some time. Using his house he would need to get it appraised officially.

 

As for me, I sent wet signature copy. Some will say scanned is fine; but why leave it to chance? Just have him mail a copy. And if getting all the asset information and appraisals is too much again just have him get a co-sponsor in case. Always good simple backup plan.

Thanks for the reply. I understand what u say and I agree. I guess co-sponsor wont be an issue; however, I wonder the embassy should have any issue with his unemployment.

That's true. :) I have my savings too. Do they consider beneficiary's assets too?

No, not for K-1 really. Perhaps for CR-1(spousal) it might a bit.

 

Also again during the AOS he has to again provide the I-864 financial form so all of this get's repeated. Now at that point if you merge your savings (joint account) it could be used.
