Long story short, I am a US Citizen, my husband is a Peruvian citizen.  We live in the US and have been married 11 years.  He is a permanent resident.  We are in the process of getting a divorce.  We have one daughter, two years old.  The thought crossed my mind that even though I have her US passport in a safe place, that he could try and get her a Peruvian passport as Peru allows dual citizenship.  Does anyone know if this is possible or have you gone through the process yourself of getting your US born kids dual citizenship/passport in another country?  I think they require both parents to go to the Peruvian consulate and provide her birth certificate, but I am not sure if there is a way around this if we are divorced, that he would be able to get her a Peruvian passport on his own and take her out of the country.  He has not mentioned doing this, and I don't foresee him doing this, but things can get ugly during divorce and I want to have all my bases covered.

I looked into getting my daughter a british passport (I'm british my husband in US citizen) and when I contacted them to find out what documents i needed it was as follows....

 

My birth certificate

My husband birth certificate 

Her birth certificate (she was born in USA)

Both MY parents birth certificate

 

 They needed proof my british  citizenshop went back more than 1 generation on my end.

 

It all depends on what his home country requirements are...

April 8th: AOS sent

April 11th: Recieved at Chicago lockbox [Day 0]

April 25th: NOA1 date (never recieved e-notifications) [Day 14]

April 29th: NOA1 hard copy recieved in the mail [Day 18]

May 9th: "Fingerprint fee recieved" [Day 28]

May 12th: Reciept number's start working on USCIS case status website [Day 31]

May 20th: Biometrics letter recieved [Day 39]

June 1st: Biometric appointment [Day 51]

​November 12th: Interview letter received ​[Day 216]

December 1st: Interview day! APPROVED [Day 235]

December 5th: Case status changed from "fingerprint fee received" to "Approved" post dated Dec 1st [Day 239]

Received approval letter in the mail for Green card [Day 239]

December 6th: "Card was mailed to me" [Day 240]

December 8th: Green card received in mail!!! [day 242]

for minors...both parents need to give consent if they want the minor to leave the country. this was the case for my nephew also. nephew is us citizen as his father. my sister couldn't travel without the written consent

10/17/2018                After 136 days of wait in HELL, finally EAD in production

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Legally yes they need consent but they can leave without consent... my example in febuary 2018 me my husband and daughter were due to fly back to Britain to see my family BUT I had a ankle injury and needed surgery ASAP (I completely tore multiple ligaments and tendons in my ankle) due to my surgery I couldn't fly so I cancelled my flight ticket. The tickets were non refundable so my husband and daughter went ahead and went to britian (with my permission ofcourse in fact I made him go so my family could see my daughter). My daughter is only 4 and there was no questions asked or no proof of consent requested that I allowed him to leave the country with her. So yes legally both parents need to give consent BUT in my case it's clear border control dont questions or ask for that consent as to why me the mother wasnt there.

Presumably the child is Peruvian, the Passport would be evidence.
