how to gather evidence for i 751

hello guys,i am planning to apply for ROC soon but my biggest worry is that i dont have that much evidence as i live with my in laws and house is on their name cars are on their name they are paying for cars and house mortgage.the evidence  we have is having joint bank accounts(as couple), credit card and we do pay credit card bills ourselves.we file for tax jointly every year we dont go out much either except sometimes go to watch movie in cinema so all in all i think that would not be enough evidence and with implementation of new rule starting from September it scary  to think that one would be denied for ROC

Use on line services to do wills and medical powers of attorneys. These will help. Are you his/her medical insurance at the place of employment.

Timeline

Start brainstorming now and starting collecting documents now. The sooner the better! And spend time going through these forums...it has been really helpful for me, and many people share their full list of all documents. 

 

Some things that come to mind from what you've mentioned - have your in-laws sign an affidavit saying you live under their roof as a married couple. While affidavits are not strong proof, they can fill in gaps in your application.

 

Include quality photos. Especially ones with other people, at specific important moments (ex: with your friends on their wedding day - hard to fake this later!) or in different locations.

 

Include copies of any letters written to you both, or emails from different people. Wedding cards? Christmas cards? I have a whole folder of emails and letters written to us over 2 years that I will be submitting. 

 

Get creative and I am sure you will find that there is more to submit.

That’s good. My wife and I will be filing ROC soon as well. We neither have joint health insurance for about the same reason as you. However, we have our own joint dental insurance though, just like you, and we also got our own joint vision insurance. So just make sure to include the policy and statements or copies of proof of premium payments for the past two years. 

 

What new implementation on September are you talking about by the way?

 

Anyway, no worries, you might have more evidences you can gather than you think. You just need to thoroughly present them in a clear manner and be creative.

 

Key here is that you have documents that cover from the time of your marriage (basically to justify that your relationship has been ongoing the past 2 years). Next key is cover the categories of why they need proofs — proof of joint living residence, proof of financial co-mingling, proof of taking care of each other & proof of your loving relationship (cheesy but yes).

 

So in your case these are what I suggest on how to present your documents:

 

A. Proof of joint residence:

-Affidavit from parents (home owners) stating how long you’ve lived together as couple and that you are currently still are living together at their house. Thus explains as well why bills are not on yours and your spouse’s name.

-Copies of your IDs showing the same address

-Greeting cards sent and addressed to both of you

-random mails sent addressed to both of you (promos or notices)

 

B. Proof of Financial Co-Mingling:

- checking/savings account statements (since the time you both got married). Print bi monthly or quarterly statements.

-joint credit card statements (same, since date of marriage)

-copies of joint bank cards (debit and credit cards)

-joint tax return transcript (2016 & 2017)

-joint tax account transcript (2016 & 2017)

 

C. Other joint responsibilities:

-joint dental insurance (statements 2 years worth, policy, and cards)

-any joint membership, if any

 

D. Other proofs of relationship:

-sworn affidavits (in your case, make it at least 4

from friends and family)

-photos (since marriage and make it a lot and label them)

-out of town trips together, if any

-Wills and PoA (there’s never a too late to get this so you can get this done even the last minute).

 

See, now you have enough evidences to support your case. I know these are all something you can produce and might have.
