Should my 16-year-old daughter also sign on the I-751 form?

Basically USCIS requests all the applicants older than 14 years old to sign their application by themselves.

My daughter is 16 years old. She and I are preparing I-756 form together with my US spouse for our ROC.

We can not find a place for her to sign on the I-751 form.

Should my daughter also sign somewhere along with the I-751 form?

Any suggestion and comments will be appreciated, thanks!

Did your 16 year old gain residency at the same time, or within 90 days of you gaining it?  If so, I don’t believe her signature is required on your form and she does not need her own form.  If she gained residency 90 or more days after you, or you are now divorced and filing a divorce waiver, then I believe she would need a separate I751 form and she would sign that application since she is older than 14.

 

Others may know better.

Your Child’s Conditional Green Card

If your child received conditional resident status within 90 days of when you did, then your child may be included in your application to remove the conditions on permanent residence. Your child must file a separate I-751 application if your child received conditional resident status more than 90 days after you did.

From the i-751 instructions:

 

If you have dependent children who acquired conditional resident status on the same day as you or within 90 days thereafter, then include the names and Alien Registration Numbers (A-Numbers) of these children in Part 5. of Form I-751 in order to request that the conditions on their status be removed as well. If you have dependent children who did not acquire conditional resident status on the same day as you or within 90 days thereafter, or if the conditional resident parent is deceased, then those dependent children must each file Form I-751 separately to have the conditions on their status removed.

 

In terms of the signature---the 16-year old child would be filing and signing their own separate ROC petition only if they were filing a separate form due to not acquiring resident status on the same day or after you did.

My 16-year-old daughter got her 2 years conditional GC on the same day with me. So we both can file ONE I-751 form. 

I am wondering if she needs to sign on this form.

As we tried to explain, albeit a little more wordy, no.

She only signs the form if she is filing one separately from yours.

Yes to filing ONE form......NO to her signing on that form.
