I agree with you. i want to try the Ombudsman. My fear is that USCIS will say they are still within processing times. Do i have a valid argument?

in an idea world, that would be the case, if every government agencies follow the rule of the law, nothing wouldnt be mess like this, but in reality, many things seem very different. sure, one can take government agency to the court, but it takes time and energy, and it also involve money,  a lot of money

There are DIY guides for filing such an action yourself. This would be under 8 USC 1447(b), and is actually quite straightforward, judging from a couple of guides I've read on them over the years. 

 

You certainly need to be comfortable with filling forms and things like that. But it would cost perhaps a couple of hundred dollars to file the action yourself. 

 

Only you know what is best in your situation.
