                                                               Hello/Salam and kindest regards to all the respected members in here.

 

 

 

My name is Sabih Afzal and I am from Karachi, Pakistan and this is the case of my immigration to the U.S to my parents as a child (under 21 years old) in the category F2A.

First I wanna make something clear that I am a complete newbie in these forums and the stuff related to the immigration process and I just created an account in here because I really need some help and I am really confused. So If I make any mistake or ask anything stupid please bear with me. Thanks...

My status shows :- Administrative Processing.
So here's my situation :-

 

Few things to notice in the first place :-

 

  • My sister (living in U.S) is my Agent.
  • My father (living in U.S) is my Petitioner.
  • My brother in law (living in U.S) is my financial sponsor.
  • My sister applied for the immigration for our parents after she was married in the U.S and after our parents reached there, they applied for my immigration to U.S as per the category :- F2A.

 

So everything was going fine until I had the immigration interview recently at the US embassy Islamabad on 23rd July 2018 for the category: F2-A. Everything went smooth until I went up to the interviewer. He asked me a couple of question which I answered them all and while asking me those questions he was checking my files he had which were submitted by sister to the NVC. Anyways while checking those files he told me that your sponsor filled out the wrong form which was (I-864). So he handed me a white paper saying that this paper shows what document you need to correct/submit so ask your sponsor to fill out the right form and submit it to the embassy in your city and you're all good to go. So upon looking at that paper and I came to know that the form they need is : Form I-864A as there's a cross on the line where it says "Form I-864A between my brother in law and my father. The form which the CO officer showed me was the Form I-864.

 

Now here comes the part where things get really confusing and messy. When my sister was submitting all the required documents to the NVC, she also submitted the form I-864A (which they are asking for right now) and she didn't submitted the form I-864 and after she submitted that form (I-864A). She got an email from the embassy saying that she didn't provided all the required documents.

On the attached Affidavit of Support checklist, we have put an "X" by each item you need to correct. Go
to the Department of State's website at

for Spanish and follow the instructions for the Affidavit of Support

So after this she submitted the missing document which was (Form I-864) and after that my case processed further and I got the email for the immigration interview.
So basically thing is they already had the Form (I-864A) as my sister submitted it in the first place to the NVC.
 
And now they are saying the same opposite as they are asking for the form (I-864A). I dont get it that why are they asking for it again when they already have it in their records? and if they don't then why did my case proceed further to the point of interview?
 
One point which needs to be considered is that this form I-864 A would be the contract between my father (my Petitioner) and my brother in law (my Sponsor). So i am confused about "who needs to fill this form" either my petitioner or my sponsor ? because the submitted I-864 A form was filled by my sponsor and they are asking for it again so do they want that form to be filled by my petitioner ? i am confused....
 
Also how do I have to submit the form? I mean do I have to send it to the U.S visa services centre near Shaheen Commercial Complex in my city via courier or do I have to take it there by myself? Because on this paper it is written that send the required document to the embassy via courier but on this link here :- http://ustraveldocs.com/pk/pk-niv-documentsubmissioninfo.asp
It says that you have to go there so I am confused on here as well.

If you guyz need any information or have any questions then feel free to ask me. I'll provide you as much information as i can that you need in order to help me with this case.

I know that this post has became quite long and I am sorry about that but I tried to be clear as much I possible could.

First of all, your father, the petitioner needs to fill out his own I-864 even if his income is insufficient, he is still your primary sponsor.

Second, does your brother-in-law live with your father?

If yes: Your brother-in-law fills out I-864A.

If not: Your brother-in-law fills out his own I-864 as JOINT sponsor.

If what was submitted was an i 864a then thats why there is a hold up.  The I864a is for household member they need the i864 from the petitioner and i864a for any household members of that same petitioner.

Thank you for your response, its really helpful..yes my father is living in the same house as my brother in law.. the situation is.. for the first time we had already submitted I-864 filled by my father who is my petitioner and as you said primary sponsor, and with that we submitted I-864 A filled by my brother in law who is my financial sponsor (he was household member in the contract). but then we got an email from NVC that I-864 for my brother in law (my financial sponsor) is missing. We then submitted I-864 for my brother in law as per their instructions. but now in interview they have again asked for the I-864 A between my brother in law and father. Now the confusion is: Are they asking for I-864 A filled by my father or by my brother in law? i am not getting because now they already have two forms I-864 and I-864 A filled by my brother in law(my financial sponsor) and they also have I-864 filled by my father (my Petitioner/Primary sponsor). In simple words, if they are asking again for I-864 A between my brother in law and father so in the above mentioned scenario: who needs to fill the form? Do they want my father or brother in law to act as the household member in the contract? Please help and guide me further , i would really be grateful to you for that.

I-864A filled out by brother-in-law. He is the household member.

By default, your father, the primary sponsor cannot fill out an I-864A

OP's brother-in-law lives with OP's father, so he counts as the father's household member.

HI, simple question before sharing some related information, share with us that r u over 18 years of age or under, if under why you were not sponsored with your parents? If over AOS needs different information to. Provide.
