Hello All,

 

I have been requested by the NVC to fill out form I-864W instead of form I-864 which I had originally filled out for my baby daughter.   She is currently living in China with her mother and I am trying to bring both to the US to live with me.

 

In Part 1. Item 11 of I-864W it states that I need to provide my daughter's Social Security number with (Required) in parenthesis next to it.   The issue is my daughter doesn't have a Social Security number yet.   When I completed her immigration application I checked the box requesting her to have an SSN issued. 

 

Confused, I called NVC and the representative said that in her copy of the I-864W form item 11 is not listed as required.   She suggested I should leave it blank and write in an explanation that the number is pending.  My version is from the USCIS website expires 03/31/2020.   From what I can tell the 2017 version didn't list an SSN as required.


Can anyone confirm that what NVC said is correct, that a SSN is not required even though the current form seems to say it is?   Otherwise I will need to figure out how to get the girl an SSN.

Hi,

The I-864W is the best form for your daughter since she is the child of a US citizen (you).

 

If the rep was looking at the most updated form (expires 3/31/2020) then he/she would see Part 1 Section 11 stating that SSN is REQUIRED just as you did.

 

Question, was your baby born in China? Also, SSN would only be given once she is present in the USA. 

 

My best solution would be to indicate that in a sworn affidavit with her birth certificate included to show where she was born.

Thank you for the response.  

 

Yes, she was born in China.   I was there but am not now.  She has a Chinese passport currently, but as my child my understanding is she will become a US citizen when she enters the US.
 

I have a copy of her Chinese birth certificate with my name on it.   Maybe that will work with the 1-864W.   I can try it, hopefully I can see them soon.

Is the child entitled to US Citizenship NOW, or only after entering the US?

 

In your circumstances, I would simply type all zeros in the SS number space.

I believe it is NOW technically since I am a US Citizen, my wife is a Chinese citizen, but according to the NVC my daughter will become US Citizen when she starts living with me.

 

We went this rout because we wanted her to come to the US with my wife and also because she was living in China up until now with Chinese health care, etc.   She currently has a Chinese passport, not exactly sure how that will play out. 

 

Was it the right decision?  I'm not sure but its what we did.

You don't seem to understand the question.  If she is your natural child, AND, is entitled to US Citizenship through YOU....NOW, then she needs a Consular Report of Birth Abroad and a US passport.  If she is not entitled to citizenship UNTIL she enters the US, then you did the right thing.

 

Which is it?  What REASON did USCIS give you, on which you based your decision to file a petition?

The USCIS didn't give me a reason.   The only time I talked to anyone from USCIS directly they told me they couldn't answer questions. I was basing our actions off of my understanding of the USCIS website for children of citizens.  I filed 3 petitions, one for my wife, my stepdaughter (Chinese from my wife's previous marriage) and one for my daughter.   I sent these to USCIS directly and the petition was approved earlier this year.   I then got a letter from NVC saying we needed to fill out their VISA applications, and send supporting documents before being scheduled for an interview and doctors appointments.

 

I was aware because I am a US citizen that my daughter may also be entitled to citizenship.  I believe she would be, however I was/am concerned that claiming that would have made her current life and China with my wife more complicated.   They have all visited the US on travel VISAs.  I also thought following the same process for all 3 might make the immigration process easier.     

 

We completed the applications and sent them what we thought were the correct supporting documents.   I completed 3 I-864EZ forms, one for each.   I received an email from NVC with two comments about my daughters evidence.  The first was that form I-864W was missing, and the second was a comment that they couldn't accept the copy of the birth certificate I sent, I needed to send a photocopy.

 

I called NVC asking about these comments, which is when I was told the Social Security number may not be required for the I-864W.  

 

Which brings me here trying to figure out what to do.

I would immediately stop processing of your natural child's visa.  If you were born in the US and have spent most or all your life living there, then she is entitled to US Citizenship now.  As such, her immigrant visa will be denied.

 

Immediately start the Consular Report of Birth Abroad process for your natural child, and apply for a US Passport for her.  Everything you already did and all the money you spent so far on her visa process has been wasted.

 

She will remain a Chinese Citizen as she was born there.

Hello! I have the same issue right now, NVC ask for I-864w fot my 7 year old son. On part 1 Do you fill up the form(petitioner) or it will be the beneficiary?
