Timeline

My husband was eligible to apply for his naturaization june 5th but decided to wait till return from a much needed trip to see family

He will be gone 42 days returning September 20th

I beieve now he must wait till the 20th of December as it sayshe  has to be in the country 3 months prior to making an application / Am i reading this correctly?

Its confusing how its worded. The worksheet says "I have resided in the district or state in which I am applying for citizenship for the last three months". You could take that 2 ways. Just because he went on vacation doesn't mean he doesn't still reside at your home. It is his permanent residence. But honestly to be on the safe side I would wait until he is home 3 months.

 

I'm sure someone else will have a more definitive answer.

yes the wording is strange as he has been here 3 years but looks like he needs to be here (also) 3 months prior to the actual application

Yes it looks that way. It really comes down to their definition of resided. You could take that as physically being present somewhere or you could also take that as just having your permanent home there. But again, I would wait to be safe.

no, not correct, that is only in case you move to another state. if you move, you have to live in the new state 3 months prior to sending the application.

 

a vacation trip does not count an has nothing to do with it. if he hasn't moved to a new state, the trip has no bearing and he can file whenever he wants to
