Should we mention the divorce to the embassy during interview?

So me and my wife have been through a rocky marriage mainly due to distance. She's in the states, while iam in my country working in a remote area, which makes it super hard for her to move in with me. We filed the I-130 back in october . Later on, she couldnt handle feeling lonely,  became impatient and couldnt wait for the approval. Things spiraled down from there, so she filed for divorce and sent me the papers in May. I didnt sign them yet , so i guess no further filing has happened. A couple of days ago, we received the I-130 approval email. This gave us a glimpse of hope to try and reconcile and work things out given that we will have a chance to be under the same roof . But then we thought about what would happen in the interview. If the officer never brings up the filed divorced, should we mention it to him/her?

You are still married until divorced.

 

On the other hand, one of you has filed for divorce. If you want to work things out and mend your marriage, you have to withdraw/drop the divorce filing. This way, you can go for the interview with a clean slate, not having to worry about hiding something.

[01/10, 2018]  - DAY 001  (day 2149) (US Passport) Applied for US Passport, regular processing

01/25, 2018]  - DAY 015  (day 2164) (US Passport) Passport in hand (5 years, 11 months, 3 days from start of Journey.)

 

AOS, N-400, & PASSPORT FOR DAUGHTER [OF HUSBAND TO USC]

[06/14, 2013] - DAY 001 Mailed package to Chicago Lockbox via USPS overnight
[11/21, 2013] - Day 153 SSN and 10-year GC in hand

09/01, 2021]  - (day 3001) (US Passport) Passport in hand (8 years, 2 months, 18 days from start of Journey.)

Agree with BlessedAssurance. You don't need to "sign" divorce papers - the divorce will move through the system with or without you. She needs to withdraw/drop the divorce through legal paperwork. She must file to withdraw the divorce petition. If she does not, the divorce will absolutely affect you. If you don't mention it, it might be fraud. In any case, you should have her withdraw the divorce petition and try to work things out. Work it out, if you can, because divorce sucks. Good luck!

Actually, if i didnt sign,the petitioner must submit a request for a default judgment in the divorce matter for it to go any further. She will dismiss it anyways.

She will dismiss it. But should we mention it in the interview even if they didnt ask us for it?
