If I were you... I would go to the interview, explain whatever reason you had to marry before the approval... and who knows... that might let your fiancé come to the US and have you do the AOS (adjustment Of Stattus) right away.

But NEVER lie!

She's no longer a fiancée....she's his wife. It ain't gonna happen no matter how many scenarios ppl on here come up with.

Wow! what tha hell is going on, I log in to see my post and here it was, I do apologize for this careless error, I left my computer at work while on the VJ site, wondering why my co-worker was laughing when i returned, as i read the post you all are right, concealing any info is the same as lying, no if's, and's, but's, about it, good luck on your journey!

anyway, cant the OP get annulled and still do the k-1 interview??? if its annulled, its not a divorse and i dont remember them asking about annulled marriages, just divorses. it was a thought i had guys. i could be wrong.

I think the OP is got married in the Phillipines (I didn't scoll back to the first page, but I think PI is the country of the fiancee). I believe PI's laws regarding divorce and annulment are quite strict due to the country being overwhelmingly Catholic. An annulment may take as long as a divorce. I think I remember reading that in the PI annulment is almost unheard of, that is why most get a divorce which takes a long time to be granted. Maybe someone who has knowledge of annulment laws in the PI can give a better response.

You can't get a divorce in the Philippines. Yes, anullments take a very long time and a great deal of money and would most likely not be granted on these grounds.

So its a divorce that isn't granted in the Phillipines, but an annulment yes? I know that this has something to do w/ the Catholic church's laws on marriage and the dissolution thereof, but I didn't quite remember what those were. Thanks for clearing it up. :)

Annulments take a long time and are very hard to get, and you have to schedule a hearing at a religious court. Plus, then you'd have to update the K-1 anyway, since you have to list marriages and divorces. Not going to happen in the next six weeks.

Yup - it's a very, verrrrry complicated process. And lengthy.

There is NO divorce in the Catholic faith. None. Doesn't exist. Not recognized. (Recall, perhaps, when Henry VIII split from the Catholic church way back when in England? Partly for nationalist reasons, power struggles with the pope, etc, but the bonus was, he could divorce and keep trying to find a wife who'd bear him a son!)

We're actually dealing with this issue in our case (and you thought petitioning the Feds was time consuming! Try the Church!). It's a very legal-like process with petitions, witnesses, pleadings, depositions, tribunals, etc. In some parishes, takes 18-24 months, some can do it in as little as 12 (little as, she says). But it takes very specific grounds to get one granted. And "we changed our mind" or "oops goofed" isn't enough. Basically, it focuses on intent at the time of marriage (and you know how we VJers love our "intent" discussions!). To get an annulment, you'd have to - in most cases - prove there was some defect that prevented a party from forming the requisite intent to marry.

Sorry to nerd out - but since I've been spending A LOT of time researching the issue, I thought I'd throw in my 2 cents worth of Jeopardy trivia.

And there's not much better to do since, as has been pointed out, the OP hasn't returned.

not to reveal anything to the consulate because if you do your entire process will be denied and you would be placed on administrative review,

What on earth are you talking about?

The consulate knows about the K1 application now and they will know about it when they interview for their spousal visa. NEVER lie to immigration. If you lie, the result is a charge of misrepresentation. That requires a waiver. If the waiver is denied there is NO VISA EVER.

You know what when I look at these posts, it shows me that some of you don't have a life, getting all emotional on here and all. I'm not going to apologize for something I didn't do, I spent many years defending my country and people like you with your twisted views and comments that makes the US the most hated country in the world. I respect anyones opinion whether it is correct or not. Learn how to analyze someones opinion rather than condeming them to destruction. No one has a politically correct answer to anything. You all could be wrong and you all could be right, that makes you no better than anyone else in this world. When I read these comments, I hate to put on my uniform to defend people like you foreign or domestic. I'm willing to bet you, you are the same people who embrace derrogatory comments to people who voice their opinion, you are the same people who embrace hatred and racism. I bet you embrace that Don Imus comment, the James Byrd incident in Texas, the way the US didn't respond to the Katrina victims in a timely manner, embrace segregation. You probably are the same persons that thinks that all blacks should go back to Africa and hispanics back to Mexico, etc. But for those who respect persons opinions on here may god bless you or whoever you pray to bless you. And what...pray tell...has all this to do with the comments and opinion left by you? I didn't suggest that the OP commit fraud. As for being wrong, what YOU suggested was in direct violation of the terms of service on this site.

I respect opinions...definately...but when one suggests that someone go against law and regulations that's where I stop respecting. I'll have you know right now buddy, I am NOT twisted in my views nor am I racist.
