Hi

 

We (my husband and I) want to apply for US visa to visit my inlaws . They both are green card holders. 

We live in Canada as PR. 

My FIL applied for my husband's immigrant petition , may be 5 yrs ago. They are illiterate and applied it through a lawyer. 

However since he got PR in Canada, they are not following up. 

We would like to visit them 

How should we apply for the visa. What documents should we take with us for the interview. 

My husband applied for B1 visa before in Feb 2018 and got rejected. They dint check the document neither didn't listen to hi, . Just in mere few seconds rejected the visa.

We both hold Indian passports. 

 

We both are working in Canada.

 

I work in an IT company and he is self employed. 

 

I landed in Canada as student. After graduating I got a job and sponsored my husband through work permit. 

 

Then we both applied for PR and got PR in Sep 2017.

Not sure what kind of help you're expecting to get. 

 

You apply and see what happens. During the interview no one have to look at your paperwork, it's not mandatory.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

That is the challenge...it may not be possible at this time. You can only provide what you have, and the CO may or may not want to see them. Usually, the information on the DS-160 / facts of the case are all they look at.

Yes. No guarantees if it will make a difference or not, but it is something the CO will at least see.

If he was already denied in February 2018, so 3 months ago, you should not apply again. It will get rejected immediately because your situation has not changed. The more denials you accumulate the more likely you will keep getting denials. You should wait one  year at the least.

 

Your inlaws should visit you. They will have no problem doing that.

Thanks for your suggestions. However visiting parents is our secondary purpose. Primary purpose for him to get visa is regarding his job. He drives truck and his company wants him to cross border.

He explained that thing when he applied last in Feb. Now we are thinking to apply togetherand for purpose we will say that we want to visit our parents.

Any thoughts!!!

It is illegal to work with a visitor visa. He cannot drive a truck and use a visitor visa for it. The boarder officers are not dumb. Plus, they can easily see he was denied a B1 and put two and two together. 

 

The visa situation has to be arranged by his employer.

Depends on the nature of the truck driving activities. In general, commercial truck drivers are allowed to use a B1 or B-1/B-2:

Although the requirements are strictly for international hauling...no domestic stops are permitted.

Good to know. Then if he was already denied, trying to get a B-1/B-2 and say he is going to visit parents is not good anyway.  He should apply for the B-1/B-2 and say the truck driving thing?

I was about to reply that. His employer has provided the required documentation and it is only for international hauling.

 Last time he took all the papers with him but the VO didnt even ask for it.

 

His company has asked to apply again. So I was thinking to apply together so that I can show my proves as  ties to Canada as I have a job too .
