221g, returned passport - what to do

i had my k-1 interview yday and have been given the white 221g slip. The CO was grilling so many people but my interview basically started with my missing birth certificate but I provided to her all my school documents as an option given by the embassy. But the convo kept going back and forth and the CO was interested in my history in US since I have stayed there as a student. I accidentally mentioned to her that I flew from Texas to vA to meet my fiancé and during this convo she asked me what I was doing in Texas. At which point I told her I worked there and she figured I did a job which was not related to my major. She was saying the opposite of what is truer rgeaidng OPT On a student visa. She basically handed me 221g slip and also returned my passport. I don’t have a good feeling about this but could you share any thoughts you might have? I have been back in my country and left US lawfully and it’s been more than a year ago.

She would have seen your work history, part of the information you supply so difficult to say.

Just to clarify----Were you actually working in Texas, or you just said that when further questioned?  

As pointed out above, your work history would have been outlined on the application, so hopefully your answers matched up to what information she already had in front of her.

I was working in Texas, yes. But she had questions about the job I was doing related to my studies at which point I told her truthfully too that I quit that job after two months. And then I had also applied for work visa last year after working with an employer which was refused. So I think she was all confused as to what really was going on. She made it so quick at the end that I didn’t have a chance to clarify few things for her which I’m basically regretting right now

Well the dates you worked would be on the form.

So this was OPT? Did you explain the connection?

Yes this was on opt. When I mentioned OPT to her, she rather said that you cannot get OPT until you get the job at which point I explained to her that that’s not the case. You can apply for it before you get the job. the original I-129F petition says that I stayed in Texas as we stated out that I flew from Texas to VA to meet my fiancé and worked two jobs however on DS-160 it only accepted two of my employers only which included one Texas job and not both. It didn’t let me add more which never came up plus if I remember it clearly she never documented any of this on her conputer. She did document everything of how me and my fiancé met but latter part she was just asking me without typing certain things.

I know you can work for more than one EMployer on OPT, not sure how common it is any maybe that is what confused her. Presumably the Employers filed all the paperwork needed.

For work visa that my employer had applied later, it was all official and legal. She was and is confused regarding OPT. She was aging the opposite of what the kw says. I have done it twice with two different schools plus read documents regarding Opt myself. Schools can’t make me do wrong stuff. One job that I did on opt did not match up to my studies so maybe that could cause problem but I was honest with her that it was exactly the reason why I left that job after 2 months. And that job was part time which I was never able to clarify with her. What do you think after hearing all this? What are my chances?

Ok maybe I missed something here but what does it say on the 221? Like what are they requesting you provide? If you fix what they requested maybe you’ll be ok. It’s not a good sign that they didn’t keep your passport though.

The 221g doesn’t specifically say for what doc. But it says that cuz of incomplete file they refused my visa yet. I didn’t have original birth certificate with me but gave my school docs. Now idk if that was her just deflecting the case it is it actually cuz of birth cert that I’m in this position. But CO also did say at the end that if more information is needed then they would let me know and I could drop in my passport anywhere at drop off location.

When you get a 221 they ask for more evidence and you should know from the interview what they want. It seems to me that the birth certificate is your reason why. School documents do not replace a BC. Just submit your BC. Why didn’t you take it in the first place? That’s on the list of required documents.

It is on the required documents but it also states that if you don’t have it then you can submit schools documents. I heard someone submitted that and was fine with it but I’m also part of inter racial relationship. I don’t know if that’s gonna be the problem.

I would recommend providing them that missing birth certificate, and documents about those school related jobs that seem to have confused the officer. Since one of the jobs were missing from ds-160, would be good to provide papers of it.

I know. I’d never think my past in Us especially after I left lawfully would have anything to do with this fiancé petition. And no, I did not work after work Visa was denied as a matter of fact I mentioned that to CO and she was glad I left lawfully. And no, that two month job was not provided by school. I made that clear to CO too that since it wasn’t related to major I quit.
