Odd CR-1 situation

Hey. Bit of a weird one. So I entered the US on a CR1 visa in November 2015. Unfortunately, the relationship ended (we ultimately divorced) and I came back to the UK in April 2016. I tried to get an ESTA for a subsequent visit to the US in April 2017 but it was declined. I went with the intention of using my visa but was given a two-hour grilling at Philadelphia (point of entry) and told that because I did not have some form of ID card you get after a number of months in the US, they should not let me in but would do so on this occasion. They added they would put a note on my file saying I should not be allowed entry on my visa again. Long story short, I need to return to the US next month. Again, I tried for an ESTA figuring that my visa would have expired as it was only valid for two years. Again, it declined. The US Embassy say it did so because I am still listed as a lawful permanent resident. They say to get an ESTA I would need to fill out an I-407 abandonment form. Given I would love the option to return to live and work in the US at some point in the future I am loathe to do this, however,  if I am going to get denied entry on my next visit, as they warned at Philly, then I may as well go ahead. Ditto what Dee elle wrote. Just because you were married and in the U.S. for a few months does not grant you a free pass to the U.S.  Looks suspicious, if nothing else.

Getting another ESTA is a long shot. It is considered a once-in-a-lifetime privilege. Once, you lose it, it is nearly impossible to regain.

 

Best bet is to try for a visitor visa. You will just have to show strong ties to your country and that you are not trying to immigrate to the US (again).

But OP wants to immigrate to the US eventually.  And needs to visit the US again next month. Not likely.
