Adding Spouse to Apartment Lease - Question

We will be sending in our I-751 in the next couple of days.  Although my husband has been living in my apartment since his arrival on July 1, 2015, he is not on the lease. 

 

The management company has been giving me the runaround since late 2015 about adding him.  I'm pretty sure it's because I've lived in this rent-stabilized apartment in NYC since 2009, the rent is way under market, and they're not interested in anyone having succession rights.

 

I have email correspondence between myself and the management company requesting to add him to the lease, which shows that they will only agree to add him once my current lease is up for renewal in November 2018.  This is against the law.  I also have an email inquiry I sent to the NYC Department of Housing and Community Renewal inquiring about the addition of my spouse to the lease, and the Department's subsequent reply that my management's refusal is in fact against the law.  I also filed a formal complaint with DHCR and the Office of Rent Administration, and I have the official notice of receipt and docket number for the case. 

 

I want to know if I should add all of this evidence of my attempt to add my husband to the lease, or if I should exclude it entirely.  We have a joint Con Edison account at our apartment address, NYS Drivers Licenses showing the joint address, and multiple items of mail addressed to my husband at our apartment.  

 

In general, we have lots of other evidence of our marriage and lives together, co-mingling of finances, and we have a son who was born to our marriage in March of 2016. 

 

Thoughts about adding this apartment BS to our ROC petition?

If I were you, I would put that e-mail correspondence between you and the management on not able to add him on the lease.  And perhaps Apartment management can write a letter to state that you are living with your husband. My Apartment property was able to do it for me when I got scary intend to deny letter from USCIS on I-485 so as to explain since my spouse was not on lease initially. I know this is for I-751 but still could save you RFE or even interview.

I actually got into same situation with you. I was not able to include my name to the apartment lease that we are renting since 2015. What I did was luckily my cousin is a US citizen and she lives in NYC, I got her to be a guarantor for me on the lease, hence, there will be 3 names. I explained in my ROC documents about the lease agreement and why her name is on it. After 2 years, with credit establishment and paying on time, I was able to remove my cousin's name.

I wrote an explanation letter in front of the rental lease agreements and bills stack and include management and my cousin's contact information.

I also included email correspondence and verification from my cousin showing that she resides in NY and not with us.

With other evidence you got, I'm pretty sure u will be fine, just write an explanation letter. I'm sure they will understand.

22 January 2018 - Biometrics Appointment letter received

30 January 2018 - Biometrics Appointment

11 August 2018 - 18 Months extension received (Exp on Sept 2019)

8 April 2019 - I751 Approved

12 April 2019 - NOA and greencard received
