Hi everyone. My Civic test and interview is this week. I just want to ask for some of your experiences during the test and interview. I got my GC through an approved VAWA. My wife and I are still married but I am already separated from my her for 11 years now. My question is, when the officer starts the N400 routine questions, and ask me if am I currently single, married, divorced, or separated? what should I respond? will the officer ask me why am I still married to my abuser? Due to budget constraints and prioritizing my immigration case were my priorities that’s why I haven’t done the divorce. Will that reply enough? Please any answers and experiences the same as mine will be a great help. Thank you everyone.

if and when they ask you....your answer is in your question. Separated. No need to answer in long form, unless they ask.

10/21/2018                Card was mailed to me, and yes it said so on a Sunday night, while Vj-ing

10/22/2018                Card was picked up by the USPS

10/24/2018                EAD in hand. F%^&& finally

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Hi Alabamak1 thank you for your reply. I plan to answer that the only problem I have is I marked the box married in my N400 application. Should I just reply married and just wait for the officer to ask more questions or to follow up? Thanks again..

Why would you mark "married" if you had the separated option? 

 

You need to read and think before you fill in forms.

Why did you mark the box "married", instead of the box "separated"?

At the very beginning of your interview, you need to inform the IO that you have incorrectly filled out your marital status on the application and would like to correct that now.

It won't cause a delay.  Be prepared for the IO to ask why you listed yourself as married though rather than separated.

Hi Going through. Are you sure? I have a feeling any corrections would might delay any processing. I marked the married box because I am still married to her but yeah we are separated. I got confuse. 😞😞😞

It's a minor mistake on the application that, as you said, you made.  You were not trying to mislead or lie.  You did not neglect to mention a sordid criminal past.  You checked the wrong box by mistake.  You are not the first one to do this, nor will you be the last.  Relax, take a breath, tell the IO at the beginning of the interview that you need to update the application and tell her the correct marital status and tell her why you didn't list yourself as separated before.  In the realm of all things that could delay an N400 case, checking off the wrong marital status box is not one of them....especially since you will be forthcoming at the interview about your honest mistake.
