WHich state are you in? DIVorce forms and laws vary per state. I can only speak for CA but courts mosty have a self help center that will supply you with the forms and then they have paralegals that will look over your forms before you submit them if you are not represented by an attorney. I did it all by myself and it was not that difficult. LEt me know if you have questions.

Thanks for your response. The divorce will be filed here in Colorado

@Weldonboy my divorce was in California and it took 1 year 4 months I think because we have a kid.It was uncontested too.You can go to self help in court and they’ll assist you in putting together the paperwork.

If you filed for work permit 3months ago then it should be the EAD, if you didn't ask to renew your EAD they probably approved your GC without an interview.

Hi Sandraj,

I didn't file for EAD at all as my EAD will not be expiring until April 2019.  This is the only update I have had since the day they received my case.. I had no RFEs on the I-360 it just went from fees been waived to card is being produced.

There is a difference between abuse and unpleasant marriage. To file VAWA based on psychological abuse, the person needs to prove EXTREME CRUELTY.

1- Depositing a fake check with her name into the joint account is not considered extreme cruelty.

2-  Going to your Country and meeting another man is not considered extreme cruelty, she is a cheater that is it.

3- Her  ex-boyfriend writing a letter to your wife is not considered extreme cruelty.

If she physically abused you then you should submit a police report or a shelter letter or a valid restraining order.

Hello Sandra:

Can you give me your opinion about if you consider the following example as economic abuse:

If the abuser withdraws the money from the joint account and places it in a personal account, leaving the account in common in zero (0) balance and two days after the abuser has decided to accept what the abuser is demanding, the abuser returns the money He had withdrawn from the joint account, that is, that there were several times.

Please give me your opinion

You are most likely going to receive an EAD under category C31. I got an approval on my I360 shortly after receiving the EAD but others who have received the EAD haven't gotten formal approval yet. IMO it's probably the first phase of the approval and depending on the adjudicating officer you may get more good news soon.

Thank you for information.. I do hope to hear soon. I will wait in the card to get here..

I didn't do it through them so I have no idea. Official offices are reliable

If you submit an online request for back ground check with the FBI , it takes them about 2 to 3 weeks to send you the result sometimes even earlier. You will have to send them a finger print card in the mail when once you submited a request online. They will provide you with the address where the cards have to be sent. Also get police clearance report from all the states you have lived in for past 3 years. I am assuming this is for good moral character RFE

Hi, please I am new here and been trying to figure out where I can post my concern for feedbacks on my doubts, I see you have some knowledge and below is my story please if you or others can shed some light. Thanks

My spouse initially filed I-485, I-130 etc. for me in June 2017 which is my priority date and afterwards the abuse got worst so I filled I-360 in September 2017, received EAD in December 2017, got RFE for moral character in January 2018 and I responded, in March 2018 got an update of I-485 approval, in May 2018 got interview notice for my AOS, attended interview on 21st June 2018, IO only asked biography questions and I-485, but my question here is I am yet to get an approval for my I-360, has anyone experienced such trend of I-360 petition and will my green card be likely issued without official I-360 approval? Thanks as any response will be appreciated

Did your spouse go to the interview with you or did you go by yourself asking the IO to put your I-485 on hold until a decision is made on your I-360?

Hello,
The problem is that I currently live far away (in another state) where I lived previously. I thought that with the FBI report was enough.
Question:
1. Aside from the FBI report, I will need to go to each precinct of the police where I lived previously to look for the "police clearance" letter?
Thank you…..

My spouse did not go with me, but the IO officer told me that all I have to do is wait for the I-360 approval and that I may not likely come back for an interview as he conducted an interview on the day and gave me a letter confirming that. Before the interview I got a notification of I-485 approval.

Typically you have to ask the IO in the interview to put your I-485 on hold in abeyance of your I-360 petition. Your I-360 petition will have to get approved first (which seems to take around 15-19 months currently), then your local field office will look at your I-485 again but it is likely that you may have to attend the interview again and submit your medical results again as your old ones will no longer be valid anymore.

Thanks, so I just have to wait?
