My partner and I have been living together in Australia for about 2 years. We have just gotten engaged so we are looking to apply for a K1 visa and are about to submit a I-129f petition. 

Does anyone know if my American fiancee will need to prove domicile as she's been residing in Australia for 2 years now? If so does it need to be done prior to submitting I-129f form? 

She has been back to the USA 4 or 5 times in the past 2 years. She still has a bank account and filed tax returns. She also still attends university online through OSU. 

Appreciate anyones help.

Yes she might be asked about domicile. I lived overseas for 13 years as the American citizen. It’s good she has kept her bank account and assume her drivers license.  I filed my I-129 from China and got approved while I was living in China.

 

It’s important to have everything ready on domicile prior to the foreigner interview. I would also recommend having a letter from wherever she plans on living. For example, I had my Mom sign a letter saying we were going to be living with her before finding our own place. 

 

Personally since i lived overseas for so for so long I moved back to America a few weeks before her interview just to be safe . He did ask where I was and she responded I had moved back to America.
