Hey guys,

 

I’ve filed the i-129 but I’m not sure how to prepare for the Affidavit of Support when the interview comes around. 

 

I’m the USC petitioner. I make enough to pass the 125% guideline, which I’ve read on VJ is the Montreal standard for the K1. I’ve also read, at this stage, the affidavit is more just for the interviewer to make sure I make enough. However, I won’t pass the federal means test as I am on a federal Medicaid program with my two children. 

 

My mother has has no problem being a co-sponsor at this stage or for the i-130. 

 

Would it be okay to be the sponsor myself for the K1 and have my mother be co-sponsor later for the i-130? Is anything from this stage (K1) even taken into consideration later with a different visa?

As to the medicaid portion I'm not entirely sure how that works with the I-134 myself, hopefully someone can give a better answer about that.

 

As to a co-sponsor, you need to ensure the embassy accepts co-sponsors for K-1 visas. If they do, then you fill out the I-134 form and provide all relevant documentation. Then your mother also fills out an I-134 and supplies again all documentation needed. Both are submitted for the interview. You are still the primary sponsor, even though your mother would co-sponsor.

 

For K-1, I-130's aren't needed. Now when it comes time later for AOS inside the US after marriage, again your mother can co-sponsor. This time you will use the I-864 financial form when you submit the I-485. Again both of you will have to fill out these forms, because again you are still the primary sponsor. This is the I-864 form for you, and I believe it's the I-864a form for the co-sponsor; but that's later on so you have time to look into that still.

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview
