Timeline

I wish there was somewhere to go for true help ! My fiance and son have been in Manila for going on 8 months which was to be 1, 

She was made to do spectrum/tb test back in November and results came out negative, but again we were delayed after interview Dec 5 because  the consular denied visa until we proved her son was her son, though we paid a lawyer for documents etc, so after waiting 2 months we were told a DNA test would help, so we did such , though her medical was not approved till nov  we were told she must do medical again, now they tell her she must do spectum test again? That is horrible she just finished test 4 months ago? So 8 months in Manila and 500 for dna and 500 for medical and another 3 months her and son in hotel in manila.  My question is how can they make her do tb test again when she just completed 4 months ago?

This is horrible almost $10.000.00 in debt and bankrupt and her and son still in manila. Has this ever happen to anyone ? who can we contact for such procedures done us ?

I know of a few that had to complete a 2nd medical because it had been 6 mos or close to it (the 6 month clock for the medical starts on the 1st day, not the completion date).  You are the 1st where they had to complete a 2nd SPUTUM .. that seems out of the norm.  Reality is - you have to jump through the hoops to get to the gold ring.   

 

I also know of a few where the relationship to the child was questioned, completing DNA testing is fairly common with that process.

 

Looks like you ran the whole gambit with your process...  sorry you got it all laid on you.  May it all go smoother now.

Wow :wow:Wow!!! You have been put through the "ringer" so many times. My heart goes out to you and your family for all that you have been through. I wish that in the beginning you had been here and asked the question about SLEC and CRBA. We would have helped you along the way. But, we are here to support and answer your questions.

 

Have you asked the question to SLEC why another TB test is necessary? I think that is the first place to start. Sometimes if you ask a different person at SLEC you just might get a different answer. Just saying.

Timeline

Wasn't CRBA with them, it was the embassy questioning her son being "her son" (not his) .. I would tend to say she had a late filing of the birth certificate after he was born .. this will can cause issues/questions with the embassy as it is not unusual in the Philippines for someone to "adopt" a child that "showed up on their doorstep"  thus a late filing of the birth certificate.

 

There was a couple a few years back; when the child was born the woman's mother's name (grandma) was put on the birth certificate instead of the actual mother/daughter's name.  Then forward a few years, the woman is processing for a K-1 visa and wants her child to come with her so they go through the process of having the birth certificate corrected to show the actual mother (are you dizzy yet?) ... this of course causes red flags with the embassy.  DNA testing eventually proved the child was hers and all are now in the USA .. happy.

 

I think the crazy stuff that some do with birth certificates in the Philippines is cause for many issues during the visa process.
