First of all thank you in advance for answering my questions. So here's a brief background...I have my 10 yr GC and i've been a LPR for 5 years(via marriage), divorced twice, and have previously owed taxes (but not anymore). Never been arrested or had any issues with the law. I will also be applying under the 5 year rule

 

Questions:

1. So i owed back taxes to the state and fed for 2014 and the amount was paid NOT by a payment plan BUT from the following year's refund amount (they applied my refund to cover it).  Would this be an issue against me during my interview or affect my approval? Keep in mind i do not owe any taxes anymore

2. Regarding question 1, so do i need to write a note explaining why i didn't set up a payment plan or anything?

3. I plan on uploading all my tax transcripts on my application and add my account transcript for the year owed (2014) as proof that my balance is $0.00.....is that overkill or should i not bring it up?

 

Basically i am just very concerned that my past tax history play against me even if i do not owe taxes anymore

Hi, I owe taxes from 2016 and had my interview on 2-27-18 was approved at the spot, of course I have a payment agreement but since you don't owe anything now I don't think this will be an issue for ur N-400. The IO specified that as long you on time making ur payments you should be fine, and as long as you don't fail to file for your taxes you are ok!

Your tax refund could be used however you want. You chose to put it towards tax balance from previous year. Nothing illegal about that! Don't overthink it. You are fine. Bring your tax transcripts from past 5 years. If there is anything in writing that shows how you paid off that balance, you may bring that too. And remember, your n400 form targets current tax balance!

a person doesn't choose to pay with refund / the government will seize any money from refund that is owed

but that being said,  it is no longer an issue
