My fiance beneficiary is currently living in the Philippines on a work permit only, and she is Ukrainian. 

 

We already received our NOA1 last Feb14, 2018. 

Her work permit in Philippines will expire May15, 2018. We can file for an extension for her stay in the Philippines while waiting for her K1 visa. Or she can fly back to Ukraine and wait for her K1 visa there.

 

I already indicated in her k1 petition i-129f that her physical address is in Philippines.

 

Can i still change my beneficiary’s physical address to Ukraine?

 

Suggestions?

 

What are the risks? Will our petition be delayed? Will they require more documents?

Should she decide to go back to Ukraine, you will have to request the change in consulate once your petition is approved. You will have to call NVC(not USCIS) and request this change as they receive your petition.

So you mean i have to wait for NVC before she can move to Ukraine?

No, I'm sorry for being unclear there. She may go to Ukraine now. See, the USCIS performs checks on the petitions, and when approved, will send them to the NVC.

 

NVC is the one that distributes petitions to the US consulates globally, not USCIS, and will send your petition to Phillipines because it is in the records they received from USCIS, from you. So all you really have to do is call in to NVC when they receive your petition from USCIS and request they send the petition to a Ukrainian US-Embassy instead.

 

Additionally, you can call USCIS and ask an officer for advice. This is the best way to find out because just last year, petitions were approved in less than 6 months, now it is taking 230 days on average. Things just could be different. 

 

It should not delay your petition much because it is a normal occurance.

IS THAT SAFE FOR YOUR FIANCÉ THOUGH?!

 

back to the topic, no, not difficult, just make sure she reaches the consulate for the interview safely lol, what the hell. and if you feel like she is missing anything, like forms or instructions from the consulate, you should wait a week, then contact the embassy.

As long as Russia's actions don't affect the embassy in Kiev, there should be no problem. And since Kiev is stable and the war is in the border area, I don't anticipate there being any problem.

 

If something were to happen, I imagine they'll just move the petition and interview location to neighboring country, but that would cause delays. Again, unlikely scenario considering the conflict doesn't reach Kiev.

08/21/2019: Green Card arrived in mail
