hello, my two year visa is about to expire and i would like to change it to ten years

HOWEVER. i never received the actual two year card (had a extremely bad lawyer and just told me to wait)

after waiting for over 1 year, we went to the immigration office for literally like over 8 times to the point the offices remembers our faces.

we were told its coming, its missing. its gonna come.

Long story short, we were told all different things and the two year visa never came

now im trying to find out what is happening with my i-751 and i cant check any information or updates since july.

the form costed almost $800 but there has not been any updates since the payment was taken from my bank since Oct.

Does anyone know what to do?? I been asking a lot of people along with my senators who doesnt give any answers...

my stamp is going to expire soon.. what do i do next????/

how long is supposed to take?

what happens after my stamp expires?

am i going to be "illegal"???

any suggestions/comments/answers/your expriences would be highly Appreciated

thank you so much!!!!!

Thread is moved from General Immigration Discussion to the Removing Conditions forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

First you’re confusing between a visa and permanent residency. Anyway reading from your post it sounds like you already had a 2 year green card and applied a form I-751 to have conditions removed. With that being said there’s a serious backlog right now especially with California service center. They’re still barely touching those who filed in October 2016, so that should give you an idea how backed up it is. You said you filed in July but didn’t mention the year. If it’s July 2016 then you’re way out of processing times and need to push an inquiry. If you did file for citizenship while your I-751 was still pending chances are your I-751 got merged with your N 400 at your local USCIS field office and you’ll have a combo interview when you get scheduled for your citizenship interview. One thing you must understand is you’re still a permanent resident with a pending I-751 and will continue to be until it’s adjudicated no matter how long and no you won’t be illegal even with an expired stamp. What you wanna do is get a new stamp again once this one expires so you can continuously use as evidence of your status for employment or travel until your I-751 gets adjudicated.
