Howdy,

 

Currently on an E-3 visa, trying to clarify:

  1. If I get married, and apply for change of status, what happens if I quit my job sponsoring the E3? 
  2. All options will still prevent me from leaving the country for 12+ months?   e.g. even if you get an EAD

Depends on who you marry.

If you quit your job you need to wait for EAD to work for somebody else.

 

You will need AP to travel, c 4 months.

So I apply for change of status, and then if I left my job it wouldn't impact my application? 

 

However, I would have to wait until I get EAD to legally work again, and then I would have to wait for AP status on my application to be able to leave the country?  

 

And AP is approx 4 month from applying?   

 

Are these understandings correct?

So just to clarify one more annoying time, for a change of status application, you just need to be on an E3 visa at the time of applying?  You could lose the E3 status after but it doesn't matter?  

 

And do you know how long EAD usually takes from applying?

You do not need to be in status when adjusting through marriage to a USC

 

EAD take 4 months, ish, a combo card.

What do you mean by 'in status'?   Do you mean I can apply for change of status even if I'm just here on a tourist visa?  e.g. because I left job for e3 visa

Yes, lots of people change status, there are some limitations but none that apply here.

Oh great ok thanks so much.  I wrongly assumed the 'change of status' option was for people already on some form of visa allowing them to live here and then changing it.  So it's just the option/form everyone does that's married someone from the US?

Certainly applies to E3.
