Timeline

The USCIS received my RFE back on December 20. What I have read, they USUALLY respond within 60 days. What day would you call them and talk to tier2?

The 61st day.

 

Our experience: we called on the 50th day, told to wait. 60th day, told to wait. 61st day, transferred to T2...

I got an RFE on Dec 14, USCIS received the reply on Jan 9th. I called 1-2 times a week to check for an update, always asking to be transferred to a Tier 2 officer. We were approved on Feb. 6th. I feel regular phone calls (being polite each time of course) to check in is good so they don't let your case sit. They do have up to 60 days to respond to RFE. I know all cases are different, but it doesn't hurt to check in.

I called the second time today, the first time I talked to the person who answered the phone, (assuming tier 1), she told me to wait until after 60 days. The second time I called today, I was transferred to a tier 2, they told me to wait another 30 days.

 

It's  been 54 days today since the USCIS received my reply to the RFE. I was under the impression that they had to answer before 60 days, I guess I am wrong :(

 

I'm going to do some research on how long the have to respond to the RFE. Most people get an answer before 60 days.

That's for the petitioner to respond, uscis respond time is 60 days. 

 

However, they don't have to respond in 60 days, this is just their goal.

 

with uscis logic they don't have to do anything though! Goshhhh

Timeline

The maximum response time for an RFE may not exceed 12 weeks (84 days). However, when an RFE is served by mail, USCIS officers should include additional mailing time for the RFE to reach the applicant/petitioner and for the response to reach USCIS. The standard mailing time established by regulation is three days.Jul 13, 2011
