Hello all, 

 

I will have my interview for citizenship next Friday, and as I go down the list of documents to bring for the interview, there is the following:

 

If applying for NATURALIZATION AS THE SPOUSE of a United States Citizen:

-Marriage certificate 

-Your spouse birth certificate or naturalization certificate. 

 

Well, though I did obtain my green card through marriage, however it was OVER 5 years ago, therefore I'm confused if I will need the documents above?

Dec 6th 2011(day 0): Sent AOS package
Dec 12th (day 6): Appt received
Dec 15th (day 9): Received txts/emails
Dec 20th (day 14): NOA1 received
Dec 22th (day 16): Biometrics appt received scheduled for Jan 13th
Dec 28th (day 22): Biometrics walk-in at Varick location in NYC
Feb 14th 2012 (day 70): I-765 case update: EAD Card production
Feb 17th (day 73): I-765 case update: EAD Card production (again?)
Feb 21st (day 77): I-765 case update: EAD mailed by USPS
Feb 24th (day 80): EAD delivered!!!
Feb 27th (day 83): Applied for a SS card
Mar 2nd (day 87): SS card in hand
Mar28th (day 113): Interview date received through txt/ email for May 3rd
May 3rd (day 149): Interview at Federal Plaza, NYC
May 4th (day 150); txt/email that I-130 was approved!!!
May 16th (day 162): txt/email GC in production
May 19th (day 165): Green Card received!!!!

Removal of Conditions:

April 24th: I-751 Sent to Vermont center

April 25th: I-751 Received

Nov 14th: RFE Received

Jan 23rd 2015: RFE Responded

Feb 12th 2015: Decision date on I-797: APPROVED!

Feb 17th 2015: Card production ordered

Feb 26th 2015: 10 year green card received

i assume you still have these two documents? if i were in your shoes, i would not overthink this and would just bring these two docs anyway.

Passport 17-Feb-22 Drop-off at USPS (expedited processing and shipping) ~ 22-Feb-22 Status: In Process ~ 08-Mar-22 Passport book shipped ~ 09-Mar-22 Status: Approved. Passport book in hand.

N-400     28-Jun-21 Filed online ~ 28-Jun-21 Received NOA + "Biometrics will be re-used" notice ~ 14-Dec-21 Interview scheduled ~ 25-Jan-22 Interview. Approved. Case status: Oath will be scheduled.  ~ 01-Feb-22 Oath scheduled. ~ 14-Feb-22 Oath ceremony.   

ROC        11-Jun-20 Application sent via FedEx ~ 16-Jun-20 Case received ~ 29-Jun-20 (Old) biometrics applied to case ~ 01-Jul-20 NOA ~ 23-Dec-21 Case transferred to new office ~ 25-Jan-22 Combo interview with N400. Case approved.

I actually do not have those documents, which is why I'm a bit concern about it.

Well you can request copies of those documents, and request it to be expedited. If I were you I'd go tomorrow to the offices that issue those documents and request the copies. If you will need - you may or may not. Better safe than sorry though.

If you are on the 5 year rule you may not need them after all, but the problem is - what if you do? Every case and interview is different, we're dealing with officers that are humans so, anything can happen.

You do not need to have obtained your green card from a US Citizen to naturalize under the three year rule, you must just be married to a US citizen for three years.

Your wife filed for you in 2010? When did you immigrate? You’re probably eligible to apply under the 5 year rule already.

Yes, this. We were in the same shoes and we just brought it all! We're still married, so why not bring them. He had his interview about a month ago and the ceremony is this week. They didn't ask to see them (although we did submit copies with the application as requested). I've of the mind ot just bring it all!
