Hi everyone,

I have applied for Naturalization through getting married with a U.S spouse (3 years). My latest status from USCIS is "Case is in line for an interview" since September 26, 2017. Things happen and we are getting a divorce. Will that affect my naturalization process? below is my timeline for N-400:

Receipt: 07/14/2017

Biometric Notification: 07/21/2017

Biometric Compete: 08/11/2017

Latest Status from USCIS page: 

Case is in line for an interview.

On September 26, 2017, we started the interview scheduling process for you form N-400, Application for Naturalization, Receipt Number NBC*007961534. We will send you an interview notice. Please follow any instructions in the notice.

 

I live in Virginia, The receipt show Lee's Summit, MO USCIS office so i'm not sure how to search the processing time under which field office. Please help.

yea, you no longer would be able to naturalize using the 3 year rule. You will have to wait till you hit your 5 year mark. You CAN be asked for proof that your marriage is still a bona fied marriage ect .

By any chance you know which field office my case fallin to? Would i withdraw the case?. Or i can do parallel with my divorce process because technically im qualified through 3 years rule. I'm not trying to treat the system, but in VA we have to legally separate for 6 months before getting divorce. Thank you for your quick response.

IF you haven't moved , it will be the same field office you interviewed at to get your GC. You can also mail a singed letter asking to withdraw to which ever center receives all N-400's. You "could technically" still attend the interview and maybe not even get any questions asked BUT you run the chance of  course. I personally became a citizen 2 years ago under the 3 year rule and during my interview NOTHING was asked about my relationship with my wife ect. BUT ive had friends doing the same but THEY have been asked questions about USC spouse and for additional proof that marriage is still good ect.

You do not  qualify under the 3 yr rule. You must be in a viable marriage living under the same roof. 

Heading for a divorce is not a viable marriage. No if ends or buts about it you need to withdraw and file under 5 yr.

Yes, unfortunately.

At the interview, your N400 will be denied due to you no longer being eligible under the 3-year rule, and you will have to wait at least another 2 years to apply again (and pay the fee again).

 

The good news, is that the divorce will not affect your application under the 5-year rule later on and you can still become naturalized.
