You are divorced. That means you are free to move on and marry someone else.

Chances are a record will appear of your marriage in the Philippines. You can try and see if your name is cleared on certificate of no marriage. If it came back you're married, you might need to go through an annulment in the Philippines.

I would assume you would simply show your divorce papers. I know the PHL have strict marriage laws. If you still need to file annulment, they you can do so. Heard it was costly and timely.

 

Which brings the question, why remarry there if you don't have to. If you want to marry a Filipino you can do so in another country. In fact, you could still get a K1 by showing the divorce decree.

Why would they submit something to a different country? I can almost guarantee that Texas wouldn't submit a divorce decree to the Philippines. Especially since divorce isn't even legal there. 

 

America isn't going to keep track of Philippines marital records.

Here is the short answer. Yes you can remarry but under certain circumstances based on the following.

 

1. If you both are Filipino citizens then you will need to complete an annulment from the Philippines.

2. If you are Filipino and your x-husband is a USC and you divorced him then you need to complete an annulment from the Philippines.

3. If you are Filipino and your x-husband is a USC and HE filed the divorce then you need to register the divorce in the Philippines and you will be free to remarry.

4. If you want to remarry, do it in the US or some other country but not in the Philippines that way you bypass the Philippine Government BS.

 

US does not report marriages or divorces to foreign Governments.  For your own good and in the event you need documentation, get a copy of the divorce decree. It can be secyred from the county in which the divorce took place in TX.

I See, yeah He is American and He divorced Me also he don't want annulment. Thank you for all the info I really appreciate Your time. Atleast now i know what to do for the future incase.. Lol. Thank you again and God Bless!

Yes you can get married again.... anywhere in the world EXCEPT the Philippines.

 

If you wanted to marry again in the Philippines you would need to complete the recognition of divorce through a RTC.

I have a friend just starting that process now.  It is a 2 year and 250,000 php endeavor and that does not include the under the table "gifts" that are required to keep the case moving.  

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

Annulment doesn't need to apply here.  it can be 2-5 years and extremely costly, but with the details given by the OP, it's not necessary.

 

As Hank said, Recognition of Divorce is the appropriate step IF the OP wants to marry in the Philippines.  It will need to be filed with the assistance of an attorney in the Philippines and would likely take around and year and cost 80,000 to 150,000, depending on the attorney.  If OP marries anywhere else it's not necessary.

 

The Philippines is one of only two countries in the world that doesn't generally recognize divorces (a few cases aside).  The other is Vatican City.
