Hi Car0593. I havent received any updates yet. I put an SRP request but the USCIS folks just send me a print out of the case processing time for 601 for Nebraska field office. They dont know anything that not all 601 are processed at Nebraska.

 

Boiler- why would he need a new lawyer. incountry 601 waivers for I-485 applications are processed at the local USCIS office by the same officer who interviews at the local USCIS office for the adjustment of status.

oh wow, I hope you get a answer soon! And @Boiler yea, I get what you are saying. Even on the USCIS website that's what it states BUT in the RFE it states that it has to be sent to the same office we interviewed at. our lawyer has had similar cases in the past and the instructions have been the same

hi Car0593-

My RFE for the 485 did not state to send it to the same office BUT eventually it gets routed to the office where the interview happened. If your lawyer did send it to the office directly in addition to the central lockbox(in chicago IL) then he is a very smart lawyer and is worth keeping. My lawyer is not that smart. Who is your lawyer and what is your interview office location?

Did you apply from the UK? what i mean by that is "is your 601 from outside the country"? is your receipt number LIN or MSC?

Dad just singed all the doctuments. our lawyer will be sending our 601 waiver off tomorrow! I will keep you guys posted. Its going to the same officer that interviewed my father this past January !

Ask your lawyer whether he is going to send the waiver packet to 2 places? lockbox and directly to officer.

I dont know which way is better. If they explicitly stated in the RFE to send it directly to the officer, then i think sending it to the officer is best. BUT, 601 has a separate filing fee of $930. If the 601 is send directly to the officer they are not going to process the check. It has to go to the lockbox for the processing fee and all that.

I think what your lawyer is doing is that he is sending it 2 places:

1) 601 form with evidences for hardship to the lockbox along with the filing fee.

2) Only evidences for hardship to the officer.

He/She is a damn good lawyer if he does that and a keeper.

I don't have the letter with me right now, but he only sent it to the office where we had our interview at. It was actually delivered today at 10:20 am! Deadline was Monday! The RFE stated the regular follow instructions on the form ect BUT in the last part it does say please send it to the office directly and it has the address ect. So my lawyer went that route.. what's a little different is that the officer who interviewed us (very nice lady) called my lawyer 4 days before sending the RFE and told him that she was sending it out ect. Like letting him know to expect it... I find that weird? But its in God's hands now. We are praying and hoping for the best. Our lawyer did have a similar case with the same office a couple of months ago and it took them 5 months for a approval. so he said we should here something back within 6-12 months

Yes, after my checks were cashed i got a receipt notice for the 601 waiver from Lee's Summit, MO. The receipt number starts with the prefix "MSC". You really lucked out that they wanted to send the 601 directly to the officer. It will be processed faster. I envy you. I dont know why i was asked to file the 601 waiver in the lockbox, although my waiver is in-country. What is your processing office again?

Greer, SC... but there's nothing to envy really.. We applied for his AOS back in September of 2016... It seems like the office is really back tracked since we only had interview on 01/29/2018.. BTW.. I saw on a different website this guy with a similar situations as ours.. he had his interview back in January, and they gave him a RFE for the 601 since he was found inadmissible for misrep/fraud... he send his waiver in the first week of April and only 3 weeks later he got his approval and then last week his AOS was also approved! I did message him this morning to ask him if he sent it directly to the office or to the processing center
