EAD Work Permit Question

So I just married my fiance who was a K1, and I wanted to know if I HAD to pay for the Adjustment of Status before she can apply for the EAD Work permit. I'm assuming Adjustment of Status application + fee is probably required before you can apply for work permit, but I just wanted to know for sure regardless. Any help would be greatly appreciated !

There's an option to apply for a EAD for a K-1 holder before AOS, however, it doesn't do you any good. It's a total waste of money. Such a EAD would only be valid as long as the i-94 (ie 90 days from entry) and since it currently takes about 4 months to even get it approved.. well.. 

 

So yes, the only real option is to file for EAD and AP when you file for AOS.

Dee Elle, maybe i'm just confusing myself with your response. " . when you apply for  EAD and AP  at the same time as you lodge the application forms for the AOS, there is no charge for the EAD / AP. ". No charge for the EAP, but whats the AP ?

Advance Parole, always recommended to file for when you file for AOS. It's for free just like the EAD.
