Years ago in 2007 I filed an I-129F application for someone, but they never got a visa and the relationship ended.

 

On August 13, 2007 it was approved by USCIS and I have a receipt number from that.

 

In 2008 I sent a letter to the Consulate requesting the petition to be withdrawn. They replied saying I need to send an original and notarized letter of cancellation and they will return the petition to USCIS.

In my infinite wisdom I never followed through and just abandoned it.

 

When I check the status of the visa on https://ceac.state.gov/ceacstattracker/status.aspx using the Immigrant Visa Case Number, it says the case was last updated October 6, 2009 and was returned to NVC.

 

All of this occurred about 10 years ago, I have moved several times and no longer have access to the paperwork.

 

I have been married to someone else for 3 years, and plan to file an I-130 sometime in the near future.

 

Can anyone help me with answering Part 5 of the I-130 form?

 

It has been so long I have forgotten most of the information and haven't  a clue as to what to write in the blanks.

 

Thanks for any clarification you can provide.

Surely you remember the person's name and the city they live or lived in? 

 

You only need that plus the date it was filed. You can get the filing date on the USCIS website under "case history" - the same place where you recently checked the status of it.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes of course I remember the name.

 I have found conflicting information on what to include for the "City/Town" and "State"

 

It doesn't have an option for an international address, and some people say to include to destination where it was filed.

I cant remember if it was Chicago or Dallas or wherever I sent the application package off to. I think it was a postbox, but it has been so long.

 

And the "Result" portion also has me confused. The application for I-129F was approved, but the visa was never collected and the case was returned.

 

Should I write approved, withdrawn or denied?

 

 

 

Also, when I check the case history it only shows this information

 

"On August 13, 2007, we approved your Form I-129F, Petition for Fiance(E), Receipt Number WAC07167XXXXX. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

 

07 167 is the filing date?

Write I- 129F was Approved,K-1 Visa was Withdrawn

That's wrong because there was no K-1 visa applied for.  The answer is "Petition abandoned after approval"

 

An I-129F is a petition, not a visa application.  A petition OR a visa application can be withdrawn, but since no visa was ever applied for, neither a visa or a visa application was withdrawn.

Case numbers beginning with WAC were processed in Laguna Niguel California.  That would be the answer, even if you mailed the petition to the Dallas PO box.  The USCIS office associated with that PO box is actually in Lewisville, TX, not Dallas, but Laguna Niguel, CA is the answer you are looking for.  If you include the case number they will know that, no matter what you answer.

I have a Visa Case Number that was sent to the embassy, it states it was returned to the NVC.

 

For reference, here is what I receive when I plug the case number into the website.

 

"petition abandoned after approval" and both reference numbers included on page 12 is how I am planning to continue.
