Ok so here's an idea of exactly where i have found myself In my quest of changing my wife's status . So I havent started  filing the paper work I have paid lawyer fees and have collected all my necessary paperwork. And i was going to file this week but this past weekend i had a couple of drinks and shared a ride with best friend/neighbor and we ended up getting pulled over and taken to a drunk tank. in this process my best was charged for posesion of marijuana and a dwi.  I also was charged with posesion of marijuana and public intoxication My friend told the cops that there was no drugs in the car so when they searched the vehicle they found my friends weed. I think that because my friend didnt take ownership of the weed is why they took me in because before anything was found they were telling me to call a ride 

So long story longer i plead not guilty and they took me to county jail before going to jail i spoke with a judge and i made sure to put not guilty as my plead 

 

What kind of affect will this do to my wifes status and processing?

 

Is it better to wait for filing the paperwork until after the i take dilema this to court ?

What advice can you give about my upcoming court date ?

if you are the USC petitioner, then it doesn't affect your wife's petition, now if you are filing a green card for her, then it's not citizenship

 

she will become a legal permanent resident

I'm assuming you are getting ready to file the ROC for your wife?  (Considering the forum section where you posted this)

 

If so, your arrest/charges will have no bearing on her  application.

 

As for advice on  your upcoming court date---my advice is to tell the truth. :)
