Visiting the usa while in a CR1 process?

Hi, 

 

i was trying to search the site regarding visiting my husband while in the middle of the CR1 process. I have been hearing that while my CR1 petition is in place I need to remain out of the usa until I am approved. Is this the case? I hate being away from my husband I miss him so much and is it true I am unable to visit him? I guess he can come visit me in the UK and I could travel to another country and we could vacate together. But it’s easier for me to hop on a plane to the usa as I work for an American airline carrier

 

any advice is grateful

Yes you can visit him in the US but at the Immigration you may be questioned about your visit as your CR1 is under process so tell them you are here only for a few days and will go back and return on CR1.

Ok thank you, I work at an airport in the UK and I spoke with an immigration officer and she was adamant that I can’t visit and also my lawyer who we were going to use suggested I didn’t. And I you can see what I got rather confused if I could or not. I do have a job to go back for I can’t leave that until I’m ready to come here thanks for clearing it up

Yes you can visit, you just can not stay long. if you come initially to visit and leave within a decent time, you should not have problem during your subsequent visit

I visited more than once from the U.K. during the process. Not a problem at all.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I visited about six times while we waited for the visa - usually 1-2 weeks at a time about 2 months apart. I always had a return ticket, a letter from my boss saying when I was expected back at work etc. I was never asked for any extra evidence apart from the return ticket. 

 

I always said I was visiting my husband - they never asked me if I was immigrating or intending to. They didn't seem to think it was weird that we were married and living in two different countries.

 

I often got asked where I worked - and it was a high profile international news organization so the reaction was either "that sounds exciting" or " you know you can't do any reporting as a visitor don't you?"
