They do need to update the forms for that question...a simple "for the previous 3 or 5 years" would be a good thing to add!

 

If you were to add the time you resided outside of the US under the travel question, it would confuse the adjudicator because it would make you seem ineligible right off the bat considering the physical presence criteria of that portion of the application ;)

Yup. Since I'm completing the form online, is it okay if I don't type the 3 and keep the 5 but just answer for the 3 years period?

Yes.  You can also print out the form (if you are mailing it in afterwards) and just cross out the 5 and put 3 in black ink.  That's what others have done here.

 

If you are filing the form electronically, then just list the last 3 years of travel.

Hi everyone,

I'm I-751 Dec. 2016 filer, I'm preparing my N 400 filing and had forms filled out. Due to this year the unprecedented delay of CSC. I'm debating whether or not I should file N 400. As if I do so, the chance of being requested for ROC interview is much higher (I read in other threads people said most likely they'll combine 2 cases and have combo interviews)

My question is:

Is 90-day window the only valid time frame to file N 400 based on marriage? After the 90th day, does the applicant have to wait until 5 year to file it again?

The 90-day window is the earliest you can file - you can file based on 3 years anywhere between Day-90 and 5 years -90 days - after which you would select resident for 5 years.

 

However, 2 things to keep in mind :

 

- if you file now, and your ROC has not yet been adjudicated, you will most likely have a joint interview. This seems to be the trend in combining the cases.

 

- even if you file for 5 years residence, the basis on which you obtained your GC will be questioned -

especially if you did not have an ROC interview.

I had been a resident for almost 10  years, divorced my ex after 7, remarried a year later, applied for N-400 2 years later ( this year) - no criminal history, no overstays, obtained my GC back in Europe under CR1 , no issues with ROC,  nothing to indicate any issues with the N-400 - the IO at the interview GRILLED me for 30 mins about my first marriage - went all the way back to 2006, had me tell her the full story again and again - asked me multiple times if I got married for GC etc ....she did not look at all at any transcripts ,etc  she smiled and approved me in the end but it was one of the most terrible experiences ever -

 

point being, if you think you will get away from being asked about your marriage when filing at 5 years - it will not happen - they will want to make sure you obtained your GC legally the first time and will question you going all the way back to when it all started....

  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated

naturalization is their last opportunity to determine whether the GC was obtained legally - there have been cases here where a daughter went for naturalization and was sent to bring proof that her father ( who had sponsored her) worked for the company that sponsored him.

 

so they may be ok at AOS or ROC but naturalization is def the gate keeper.

Many thanks for your reply Candybabe, your answer is very helpful. I don't mind they asking me questions about marriage. But I think probably I should file N 400 upon the approval of I-751 next year.

you may save a lot of time, by not waiting for the approval, but applying as soon as you are eligible.... so when you do interview you will get your citizenship directly....
