There is no extension to file AOS. As long as you're married, you can file AOS when you're ready. If you go out of status when your current visa expires, your overstay is automatically forgiven when you file AOS. Note, all of this assumes that the beneficiary remains in the US continuously. If you travel out of the US before you file AOS, then you will have to file for a CR1 abroad.

Hmm, I don't know the answer to that one, and I'm not sure you can find it searching the forums as it seems pretty uncommon since most filers are in a hurry to be reunited with their spouse/fiance, abroad.

 

I guess my advice would be to call support at USCIS/NVC/embassy (wherever your case sits) and ask for a tier 2 support specialist and ask them directly. Good luck.

You might also start a new thread and ask this again with "Affadavit of Support" spelled out. Give extra details about your case. Is it a k1, cr1, is it at NVC, etc.

You have a year to respond to any request.  Your response could be anything from a request to extend the time, or to simply submit an unqualified or incomplete affidavit.

Thanks pushbrk. Curious, would you know when the 1 year count begins?

Last email I received from NVC is dated Jan 3, 2017 where they sent me the Affidavit of Support cover page..

U.S. DoS - CEAC Confirmation was received Dec 27, 2016

To be safe, contact them before the December date.  Contact them now.  How much more time do you actually need?
