Does Obamacare penalty apply to a nonresident alien?

I think there is a rule that will consider you resdent alien for tax purposes even on non resident immigrant visa. I am in US for a long time on non immigrant visa but if I dont maintain health insurance then I will be penalized bcoz for tax purposes I am considered resdient alien. Check irs website or turbotax.

Yes, that's correct. If you pass the substantial presence test.

I assume you mean "non-immigrant visa"
