can my fiance travel to US during the i129 NOA1 processing time?

Hi,

 

I figured this Fiance visa status is going to take awhile, so my fiance decided to visit me in late October for 10 days.

Would she be okay to visit U.S during the visa is processing? I don't think it matters but I just wanted to check we are not going to get a trouble when we interview her visa.

Yes she can.  As long as she is legally able to visit the US, there is no reason that she shouldn't make the trip.  I'm assuming she would have a return ticket ?  It's uncommon to have any trouble at US immigration but making sure she has proof of ties to her home country can help if she is questioned.  I traveled several time from the UK during our K-1 process and never had any problems.  The only thing that can start counting against her is multiple long trips where she could be seen to be abusing her tourist visa or staying in the US more than she is in her home country.  As long as visits are relatively short and not overly frequent, she should be fine.

03/27/2008 - I-751 Approved, 10 Yr Greencard in the mail !!

12/20/2016 - N-400 mailed to Phoenix lockbox

01/17/2017 - NOA Received

01/25/2017 - Attended biometrics in St. Louis

09/29/2017 - Received I-797C notice dated 09/27/17.  Interview Scheduled for November 6th @ 8am

11/06/2017 - N400 interview in St. Louis.  Approved !!:jest:

02/05/2018 - Notice of Oath Ceremony date received.  March 1st, 2018 @ 8.30am

Yes, she should be okay to visit as long as she already has a tourist visa or is from a VWP country.

 

If she still has to apply for a B visa, the embassy is unlikely to issue her one while a visa with immigrant intent is pending. If she is eligible for an ESTA, she will be okay.

Yup, no issue with visiting. Just be sure she carries evidence of her ties to return home in case she is asked for them.

This is true. My fiance has visited me since filing the I-129F. They just asked him where he worked, which was the only question beyond asking how many days he would stay which is typical.

 

luv2teach77: when you traveled, did you travel DURING the "K" part of the process up until you had your interivew? My fiance has a ticket booked for near his interview time. When we bought the ticket, we didn't realize when his interview time would be. Is it safe to travel then? Do you have any experience with this? For the record, my fiance has visited the US twice and left, never staying more than 2-3 weeks at a time.
