AOS question (wife's salary certificate)

I sent my AOS/IV packet for my wife (the applicant) off last week and I just realized that I did not include a copy of her salary certificate with my tax information. All of her income is foreign income, paid out in a foreign currency (Kuwaiti Dinar). Even though she DOES NOT have a W2, her income WAS included in the tax return for 2016 as it was a joint return, but we are solely using my assets to qualify (my income is paid in USD but it is all foreign income that will not continue once we go to the USA). 

 

I provided my W2 and a tax return transcript for 2016 in the package, as well as W2s and 1040s for 2015 and 2014 (those years were single-status filing). I also included an employment letter from my company and 4 months of pay stubs and copies of my savings & checking statements. 

 

Should I mail in a copy of her salary certificate now (hopefully to avoid a future RFE once they get around to reviewing my documents)? Or is that unnecessary? It is basically just a letter from her company stating how much, in Kuwaiti Dinar, she is paid monthly. Her income has no impact on meeting the income requirement and they do have my W2 & transcript in the package.

Called NVC and they told me it doesn't matter because she is not a LPR or U.S. citizen, so her income is completely irrelevant even though it is reported on the joint tax return transcript. What matters is my W2 and 1040/transcript, which I did provide. So I am good. :-)

I was in a similar situation. I only sent my documents (petitioner) and the sent a checklist asking for my spouse to bring "all" w-2's to the interview. They didn't require me to submit additional documents to the nvc. I'm not sure why they sent the checklist since I did send all of my w-2's, but just in case I am preparing a letter to explain all of the income on my tax return along with my 1099's, etc. But my w-2 that was sent covers like 90% of the reported income and is well above the thresholds.

2016 Feb - First trip to China (10 days): met friends and family, celebrated Spring Festival (Chinese New Year), lots of sightseeing (including seeing pandas), and lots of food

2016 Feb 06 - Purchase matching jade necklaces to mark engagement

2016 Jun/Jul - Second trip to China (10 days): lots more sightseeing, food, and time with friends/family

2016 Sep/Oct - Third trip to China (10 days) this time with my parents so that my parents could meet him and his mom, along with lots of sightseeing and food (i'm sure you've picked up on a trend by now :D)

2016 Oct - At the end of the time in China my parents, myself, and Xuan all traveled to Canada (7 days) so that we could get married, but unfortunately his mom couldn't come along with us.

2016 Oct 08 - Wedding day on top of Mount Washington on Vancouver Island, and it had just snowed the night before. (L)(L)

2017 Jan - Fourth trip to China (7 days), you guessed it: food, family, friends, spring festival, ...


The CR-1 Process:    NOA1 - PD 27 Dec 2016 (TSC)

2016 Dec 21 - Sent I-130 packet (along with G-1145 for e-notification) by USPS priority mail express (1-day), but missed the pick-up so it won't actually leave till the next day

2016 Dec 23 - Delivery confirmed by USPS

2017 Jan 03 - Payment drawn from bank account

2017 Jan 04 - Text and email confirming USCIS receipt of petition, assignment to Texas Service Center for processing and SRC case number

2017 Jan 09 - Received I-797c notice of action by mail (NOA1) with assigned priority date of 27 Dec 2016

2017 ??? ......... just waiting patiently for NOA2 (hopefully by April/May if they ever stop transferring cases from Nebraska)

The NVC person also told me "worst case scenario, they would ask you to bring it to the interview." So I will be prepared for that with a letter and a copy of the salary certificate, but he ensured me that the NVC itself wouldn't need it. And like you, my W2 covers more than 90% of the reported income, and my assets alone (which are probably what they will use since my income will not continue when I return to the US) are well above the threshold too.

yes, they don't care about the finances of the immigrating alien. However, the tax transcript does not break out the various sources of income and who earned each. Therefore, if you file as married filing jointly it seems that they want an accounting of who earned what money. If the petitioner is the only one who earned income, and it was simply income reported on an W-2, then providing that W-2 makes it clear. However, if the W-2 does not cover all of the income then they ask for more information As stated by the OP, the NVC won't hold things up, but they will ask that more information be provided at the interview.
