You are definitely optimistic. Beware that these things can definitely come back to haunt you. 

 

Overstaying in the United States may only be a civil matter, but you also get bans if you overstay. The United States doesn't mess around with immigration and overstaying in any country can have an impact on applications. 

 

I understand you can't just change her mind, but she needs to understand that it could very well impact her getting her visa, as it shows lack of good character in regards to immigration law.

As long as the police system is not linked to immigration system it shouldn't be a problem .. I doubt it is linked with immigration as most European countries have different departments for such kinda matters .. regardless you have no option other then obtainning this certificate .. at the end of the day she has to pass through customs at the airport when she fly back to home country they will find out she has over stayed .. last option she can apply for it when she is back home in Brazil , it will be easier

You're not getting the answers you want?  People are trying to help.  How do you think the US is going to look at her overstaying a visa in another country?  That's illegal.

I'm not asking for people to sugar coat things. Just trying to wrap my head around all the rules. I'm well aware that the US is capable of learning this information. I know honesty is our best policy here. As I've said previously in this thread, I just have to work with the hand that I've been dealt.

I don't think there is a sugar coating for this situation.  If your GF's visa has not expired in Ireland she should get the heck out and go home.  That's the long and short of it.

This part I don't really understand...perhaps it was the way you worded it?

 

It reads as though she is making the conscious **plan** to overstay her visa---why?  I guess I just don't understand why she would purposefully (if that is true the way I read it, I apologize if I misunderstood your first post) choose to make things more difficult for her with the US immigration when applying for a K-1 later on.

 

If she is indeed making this illegal choice, I think you may need to sit down with her and discuss the difficult road ahead the two of you may be facing when it comes to applying for any immigration benefit in the US later on because it sounds like she may not grasp the consequences of her actions.

 

Even a 1 or 2 day overstay in any country will be taken seriously by the US government, and probably by the Brazilian government as well I would imagine.

She needs to follow the law and return home, not overstay.  Hopefully she hasn't overstayed yet.

With all due respect, I'd prefer not to say a whole lot else on this topic. We aren't even engaged yet, as I'm waiting for my next trip abroad to pop the question. All of this worrying is putting a damper on something I was so excited about. I appreciate the help. I will have an honest discussion with her about our options.
