Hi everyone!

 

I have overstayed my K1 fiancé visa, we got married 9 months later. Now our case along with I-130 is pending in USCIS, we got NOA-1 and I'm having my fingerprints done in few days. The questions are:

1) can i travel within USA by plane having only my international passport with overstayed fiancé visa?is my NOA 1 could help me smb asks me my status? Or better wait green card and then travel? I'm tired sitting home and wanna visit my husbands relatives that live three states away.

2) can I obtain state ID and driving license after i have my EAD(work authorization)? I've looked ob our states requirements but i wanna hear from people on VisaJourney.

1) While your AOS is pending, travel with your passport + AOS NOA1 + marriage certificate.

 

2) Yes, you can easily obtain a driver's license or state ID easily upon receiving your EAD + AP combo card.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

It really depends on your state. I've heard from people living in GA that it wasn't that easy for them even though they where aloud. I am going to try and get mine (written test)on July 31 In Sacramento,CA (you still have to do a behind-the-wheel driving test after that)

yes you can travel with your passport + NOA. With your EAD you should apply for DL immediately. Most work place ask for your DL, you definitely need one if you are going to work.
