Me and my wife just got back from our interview.  The CO told us everything was fine but we need to have my co-sponsor, which is my father, fill out an i-864a. Originally I had sent two i-864s. One for me and one from my father.  I tried to explain that he is my the co sponsor and not a joint sponsor.  I was told because we live in the same house that he needs to fill out I-864a.

 

I'm very confused. It was my understanding that the I-864a was only if we are combining multiple incomes but he is the co-sponsor so only his income is being used to meet the poverty line. 

Can someone clarify this? I feel like what they are saying is incorrect.

That is very strange, it sounds like you did it right the first time.  Are your father and you financially tied?  ie is one of you claiming the other on taxes?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

No we aren't financially tied. I tried to explain to them that even though we live in the same household that we file taxes separately and I support myself. 

I will send the form if I have to but I wonder if there is a way to just get this cleared up through the NVC or something. I really don't want to wait in AP since I've read stories of people being in AP for long periods of time.

To get the semantics out of the way first, co-sponsor is not the correct term when referring to an I-864, joint sponsor is.  Anyone who fills out an I-864A is a household member, not a joint sponsor (and not a co-sponsor).

 

NVC will be of no help since your case is at the Embassy.  Your choices are:

  • try explaining it to them again that you are not combining income with your father, he is acting as a joint sponsor and not a household member.
  • send the I-864A

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
