Hello Everyone,

 

My wife recently adjusted her status from a K-1.  We received her Permanent Resident Card in the mail the other day and her category code is listed as a CR1.  Since she is a K-1, shouldn't her category code be CF1?  That being the case, should I have her Green Card corrected?  Or does it matter?

It matters, and the sooner it's fixed, the better.

 

File I-90 and set up an infopass appointment to gain the temporary I-551 stamp in her passport, so she can still claim with evidence that she is an LPR. There is no filing fee when the mistake is at the fault of USCIS. She won't have her physical green card for a while, but the stamp will act as her green card in the interim, so she will still have all the same benefits as an LPR, because she is one.

No problem! While you wouldn't notice it now, filing for ROC down the road might complicate things. 

 

CR1 = Foreign Spouse of a USC

CF1 = Foreign Fiance Married to a USC

 

Both have a 2-year conditional green card, but I can only assume that based on the category alone they might RFE your ROC down the road to show evidence of the CR1/IR1 visa, which would be bad, so good on you for being proactive and noticing the category on her green card as incorrect, I sure wouldn't have noticed it and it made me double-check my own! Fortunately, mine is a CF1 and correctly categorized.

That is exactly what I was thinking too.  Would hate to wait 2 years only to be questioned on why I didn't fix it earlier.

Exactly. It'll take a few more months to receive the proper green card, but at least she can still enjoy all the benefits of having one, even when it's not in her possession!

Indeed.  I keep a copy of everything.  I knew when USCIS messed up our EAD/AP, I just knew something else would go awry.  It didn't take long, and now I know what that mistake is.  Never ending process of waiting and waiting and waiting.   LOL

 

Just submitted our I-90.  I'll try to make an InfoPass appointment soon.  Seems, like there are never any appointments available.  I'll let you know how it turns out.

do you have any updates? we got the wrong category too on my wife's green card - please advise on your experience.

It's been 203 days since I submitted the I-90 with no updates other than Case was Received and a Receipt Notice was Emailed.  I'm just letting it ride for now.  I probably should make an InfoPass appointment here in the next month or so.  I figured I'd wait at least 6 months since its a low priority.  What category did they give your wife?

they gave her E27 instead of FX6 - what a mess!!! Did you get a stamp in the passport as proof of her status?

No.  We just kept the original Green Card.  They haven't asked for anything yet.

I believe it did say that.  However, I figured I'd get a RFE, letter, or something stating that I needed to submit it.  But, to date no correspondence.  I did send them a copy of her green card with the I-90.  But, I wasn't about to send in her Green Card in before I made an InfoPass appointment and get a stamp.  My attorney told me not to worry about it and just wait the 2 years until we have to submit our Removal of Conditions.  So to be safe, at least I can say I did submit the I-90 for the incorrect category.  

 

Whether its right or wrong, at least we have her green card so she can travel and work without people having to ask to see the "green card" instead of the stamp.

I like your reasoning, we're getting the stamp on 1/16 - then we will submit I-90. I wonder if they will ask you for an original one or not. SO ANNOYING ABOUT IT TAKING THAT LONG!!!

I guess the biggest reason I did not send her green card in was I was going to wait until they scheduled us an appointment.  At that time I would give them the green card and get the stamp.  Until then just wanted to hold on to it and see what came first.  The appointment or the Removal of Conditions.  Haha
